“招标人”英语怎么表达？

在中国的招标文件中有“投标人”和“招标人”的表达，就像有公必有母一样自然。《中华人民共和国招投标法》目前有两个译本，对“招标人”表达分别为“bid inviting party”和“tenderee”，（鄙人习惯译为 bidding inviter）,其实这些英文表达都中国人独有的创意，因为在国际工程中只有“投标人”，根本找不到“招标人”这个表达。但是偏偏在中国的法律中就有“招标人”这个法律术语，显然“招标人”这个法律概念或者术语的确是中国人创立出来的，也的确无法在正统英语中找到对应的表达，就像“饺子”“抄手”一样。

《中华人民共和国招投标法》第八条 招标人是依照本法规定提出招标项目、进行招标的法人或者其他组织。

译本一：Article 8 A bid inviting party is a legal person or other organization that puts forward a project and invites bids therefor according to this Law.

译本二：Article 8 The term "tenderee" refers to a legal person or other organization that propose a project and put forth an Invitation to Bid.

我们再看《美国加州大学工程招标管理规定》（BIDDING & CONSTRUCTION ADMINISTRATION）中：

The lowest responsible bidder is required to submit, to the University, Certificates of Insurance and bonds required by the General Conditions and Instructions to Bidders.

最低责任投标人必须向大学提交一般条件和投标人须知要求的保险证书和保函。

这里，“投标人”英文为bidder，而招标人却是University（大学），说明在美国也没有“招标人”这个英文表达，哪个机构在招标就用哪个机构的大名直接表达“招标人”。张三招标，“张三”的名头就等于“招标人”，“李四”招标，“李四”的名头就等于“招标人”，但是“投标人”则用“bidder”表达。

我们再看看FIDIC是如何处理“招标人”的表达的。

在《FIDIC招标程序》中也只有“投标人”Tenderer，找不到“招标人”的英文表达。

在《FIDIC招标程序》中有一个常用词汇authority，起初着实让人理解为难：

原文：in the event of acceptance of the Tender by the Authority, the date upon which, the Tenderer provides a performance security to the Authority in accordance with the terms of the contract thereby made between them, or

在通过上下文分析，鄙人就认定Authority就是指的招标人，据此理解译出：

在授权招标人接受投标书的情况下，投标人根据双方由此订立的合同条款向授权招标人提供履约担保的日期，或

网上有一个《FIDIC招标程序》的译本，把Authority译为“当局”，显然是望文生义。
