2.3提供施工场地 Provision of construction site

2.3.1发包人应在合同双方签定合同协议书后的14天内，将本合同工程的施工用地范围图提交给承包人。发包人提供的施工用地范围图应标明用地范围内永久占地与临时占地的范围和界限，以及指明提供给承包人用于施工场地布置的范围和界限及其有关资料。

The employer shall, within 14 days after the contract agreement is signed by both parties, submit the construction land area map to the contractor. The construction land area map provided by the employer shall indicate the scope and boundary of permanent land occupation and temporary land occupation within the land area, in addition to the scope and boundary provided to the contractor for the construction site layout and related information.

 

2.3.2发包人提供的施工用地范围在专用合同条款中约定。

The scope of construction land provided by the employer is stipulated in the particular conditions of contract.

 

2.3.3合同双方认为有必要时，发包人应按技术条款的规定，向承包人提供施工场地内的工程地质图纸和报告，以及地下障碍物图纸等施工场地有关资料。

Where the parties hereto deem it necessary, the employer shall provide the contractor with engineering geological drawings and reports on the construction site, as well as underground obstacle drawings, and other relevant construction site information in accordance with the technical provisions.

 

4. 承包人Contractor

4.1承包人的一般义务 General obligations of the contractor

4.1.3 除本合同第5.2款约定由发包人负责提供的材料和工程设备，以及指明由承包人提供的工程设备外，承包人应为完成本合同各项承包工作，负责提供工程施工所需的全部材料和设备。

Except for the materials and engineering equipment provided by the employer as specified in article 5.2 hereof, and the engineering equipment specified by the contractor, the contractor shall be responsible for provision of all materials and equipment required for the project construction in order to complete the contract work hereof

 

4.3分包 Subcontracting

4.3.6承包人应按施工承包合同约定进行工程分包，并经监理人审核和发包人书面认可。承包人应通过劳务合同约定进行劳务作业分包，承包人应将分包合同副本提交监理人。.

The contractor shall subcontract the project as agreed in the construction contract, and shall be reviewed by the supervisor and approved in writing by the employer. The contractor shall subcontract the labor service through the labor contract and shall submit a copy of the subcontract to the supervisor. .

 

4.3.7承包人分包应遵守投标文件的承诺。投标时未提出的，实施阶段不得进行分包。

The contractor's subcontracting shall comply with the commitments of the bid documents. If no submission thereof at the time of bid, no subcontracting may be performed during the implementation stage.

 

5. 材料和工程设备 Materials and engineering equipment

5.1承包人提供的材料和工程设备

Materials and engineering equipment provided by the contractor

 

5.1.1 除由发包人提供的材料外，其余为完成本合同各项工作所需的全部材料，均由承包人负责采购、验收、运输和保管。发包人要求承包人提供的材料在本合同专用合同条款中约定。

Except for materials provided by the employer, all the materials required to complete the work of this contract shall be purchased, inspected, transported and stored by the contractor. The materials required by the contractor to be provided by the employer are stipulated in the particular conditions of contract.

 

5.1.2发包人要求承包人提供的工程设备名称、规格、数量在本合同专用合同条款中约定。承包人提供工程设备的交货计划、交货方式，以及监理人的验收等，应在承包人办理工程设备订货时另行安排。

The name, specifications, and quantity of engineering equipment required by the employer to be provided by the contractor are stipulated in the particular conditions of this contract. The contractor's delivery plan, delivery method and the supervisor’s acceptance shall be arranged separately at the time when the contractor handles the order of the engineering equipment.

 

8. 测量放线 Measuring and pay-off

8.1施工控制网 Construction Control Network

8.1.1承包人负责测设施工控制网。发包人应在本合同协议书签订后的14天内，向承包人提供测量基准点、基准线和水准点及其书面资料。承包人应在收到上述资料后的28天内，将施测的施工控制网资料提交监理人审批。监理人应在收到报批件后的14天内批复承包人。

Contractor responsible for surveying construction control network and the employer shall, within 14 days after the signing of this contract agreement, provide the contractor with the measurement reference point, baseline and level point and their written materials. The contractor shall, within 28 days upon receipt of the above-mentioned information, submit the information of the construction control network to be inspected to the supervisor for approval, for which the supervisor shall approve the contractor within 14 days upon receipt of the application for approval.

 

10. 进度计划 Progress Schedule

10.1合同进度计划 Contract progress schedule

承包人应按本合同技术条款规定的内容和期限以及监理人的指示，编制详细的施工总进度计划及其说明提交监理人审批。监理人应在本合同技术条款规定的期限内批复承包人。

The contractor shall, according to the content and time limit stipulated in the technical provisions of this contract and the instructions of the supervisor, prepare a detailed overall construction schedule and its description and submit the same to the supervisor for approval. The supervisor shall approve the contractor within the time limit specified in the technical provisions of this contract.

 

10.2合同进度计划的修订 Revision of contract schedule

当监理人检查计划认为需要修订进度计划时，承包人应按监理人的指示，在14天内向监理人提交修订的合同进度计划，并附调整计划的相关资料，提交监理人审批。监理人应在收到该进度计划后的14天内批复。

Where the supervisor inspects the plan and considers it necessary to revise the schedule, the contractor shall submit the revised contract schedule to the supervisor within 14 days according to the supervisor's instructions, and submit the relevant information of the adjustment plan to the supervisor for approval. The supervisor shall approve within 14 days after receiving the schedule.

 

14. 试验和检验 Test and inspection

14.1材料、工程设备和工程的试验和检验

14.1.4主体工程开工前，承包人应组织人员进行施工准备检查，并经发包人或监理人确认合格以及履行相关手续后，才能进行主体工程施工。
Prior to the commencement of the main project, the contractor shall organize personnel to carry out construction preparation inspections, and the main project construction shall be carried out only after the employer or supervisor confirms that they are qualified and perform relevant procedures.

 

14.1.5承包人应按相关规定和标准对水泥、钢材等原材料与中间产品质量进行检验，并报监理人复核。
The contractor shall inspect the quality of raw materials such as cement and steel and intermediate products in accordance with relevant regulations and standards, and report to the supervisor for review.

 

14.1.6水工金属结构、启闭机及机电产品进场后，应按合同进行交货检查和验收。安装前，承包人应检查产品是否有出厂合格证、设备安装说明书及有关技术文件，对在运输和存放过程中发生的变形、受潮、损坏等问题应作好记录，并进行妥善处理。
After the hydraulic metal structure, gate hoist and electromechanical products enter the site, delivery inspection and acceptance shall be performed according to the contract. Before installation, the contractor shall check whether the product has a factory certificate, equipment installation instructions and related technical documents, and shall record and deal with problems such as deformation, moisture, and damage during transportation and storage.

 

17.1.3 计量周期 Metering cycle

本合同工程的计量周期不另作约定。

No otherwise stipulation for the measurement cycle of this contract is made.

 

17.1.5 总价子目的计量 Measurement of Total Price Items

 (2) 承包人应将工程量清单中的各总价子目进行分解，并在签订协议书后的（28）天内将各子目的总价支付分解表提交监理人审批。分解表应标明其所属子目和分阶段需支付的金额。承包人应按批准的各总价子目支付周期内，对已完成的总价子目进行计量，确定分项的应付金额列入进度付款申请单中。

The contractor shall decompose the total price subheadings in the bill of quantities and, within (28) days after signing the agreement, submit the total price payment breakdown table for each subheading to the supervisor for approval. The breakdown table should indicate its subheadings and the amounts to be paid in stages. The contractor shall, within the approved payment period of each total price sub-item, measure the completed total price sub-item and determine the amount payable for each item to be included in the progress payment application form.

 

17.2 预付款 Advance payment

17.2.1本合同预付款额度、预付时间和次数在专用合同条款中约定。预付款的担保方法可采取银行保函，以及施工设备抵押的方式。

The prepayment amount, prepayment time and frequency of this contract are stipulated in the particular conditions of contract. The advance payment can be guaranteed by bank guarantee and construction equipment mortgage.
