工程合同中的交通运输条款（中英文对照）

出入现场的权利  Rights of Entry Site

 除专用合同条款另有约定外，发包人应根据施工需要，负责取得出入施工现场所需的批准手续和全部权利，以及取得因施工所需修建道路、桥梁以及其他基础设施的权利，并承担相关手续费用和建设费用。承包人应协助发包人办理修建场内外道路、桥梁以及其他基础设施的手续。

Unless otherwise stipulated in particular condition the employer should, pursuant to the necessity of construction, be liable to obtain the approval procedures and all rights for access the work site, and acquire the rights which are necessary for construction of road, bridge and other infrastructure, and bear the cost thereof and execution cost. The contractor should assist the employer to process the procedures of construction of the road within / out site, bridge and other infrastructure.

承包人应在订立合同前查勘施工现场，并根据工程规模及技术参数合理预见工程施工所需的进出施工现场的方式、手段、路径等。因承包人未合理预见所增加的费用和（或）延误的工期由承包人承担。

The contractor should, prior to conclusion of contract, make survey and check site, and pursuant to the project scale and technical parameters, make the reasonable prediction of mode, means and path, etc. which are necessary for construction to access site. Where the contractor’s failure to make reasonable prediction thereof, any increased cost and / or delayed work term therefrom shall be undertaken by the contractor.

场外交通 Traffic Off- site

发包人应提供场外交通设施的技术参数和具体条件，承包人应遵守有关交通法规，严格按照道路和桥梁的限制荷载行驶，执行有关道路限速、限行、禁止超载的规定，并配合交通管理部门的监督和检查。场外交通设施无法满足工程施工需要的，由发包人负责完善并承担相关费用。

The employer should provide the technical parameters and specific conditions of communication facilities off-site and the contractor should comply with concerned communication regulations, drives in strict accordance with the load limit on road and bridge, observe the rules of speed limit, traffic limit and overloading prohibition, make accordance to the supervision and inspection of administrative authority of communication. Where unable to meet the needs of engineering construction by the communication facilities off-site, the employer is liable to perfect the same and undertake the relative costs thereof.

场内交通 Traffic In-site

发包人应提供场内交通设施的技术参数和具体条件，并应按照专用合同条款的约定向承包人免费提供满足工程施工所需的场内道路和交通设施。因承包人原因造成上述道路或交通设施损坏的，承包人负责修复并承担由此增加的费用。

The employer should provide the technical parameters and specific conditions of communication facilities in-site, and pursuant to the stipulations of particular condition, provide the contractor in free of charge with the road in-site and communication facilities which meet the needs of engineering works. Where any damage to the aforementioned road or communication facilities due to the contractor’s cause, the contractor should be liable to repair and bear the increased cost therefrom.

除发包人按照合同约定提供的场内道路和交通设施外，承包人负责修建、维修、养护和管理施工所需的其他场内临时道路和交通设施。发包人和监理人可以为实现合同目的使用承包人修建的场内临时道路和交通设施。

场外交通和场内交通的边界由合同当事人在专用合同条款中约定。

Except that the employer, pursuant to the stipulations of contract, provide the road in-site and traffic facilities, the contractor is liable for building, maintenance, repair and management of the temporary road in-site and traffic facilities, which are needs for construction. The employer and the supervisor may, for the purpose of contract, use the temporary road and facilities in-site.

The boundary between outside and inside of work site will be stipulated by parties hereto in the particular condition.

超大件和超重件的运输

Transportation of Oversized and Overweight Parts

由承包人负责运输的超大件或超重件，应由承包人负责向交通管理部门办理申请手续，发包人给予协助。运输超大件或超重件所需的道路和桥梁临时加固改造费用和其他有关费用，由承包人承担，但专用合同条款另有约定除外。

In respect of transportation by the contractor, of the oversized and overweight parts, the application thereof should be conducted by the contractor to the communication authority, for which the employer provide assistance. Except otherwise stipulated in particular condition hereof, the costs and other relative fees for the temporary reinforcement of road and bridge which are needs for the transportation of the oversized and overweight parts will be for the account of the contractor.

道路和桥梁的损坏责任

Responsibilities for Damages of Road and Bridge

因承包人运输造成施工场地内外公共道路和桥梁损坏的，由承包人承担修复损坏的全部费用和可能引起的赔偿。

Provided that any damage of public road and bridge within and beyond the work site due to the contractor’s transportation, all costs of repairing such damages and the compensation which may be incurred will be on the contractor’s account.

水路和航空运输

Transportation by Waterway and Air Transport

本款前述各项的内容适用于水路运输和航空运输，其中“道路”一词的涵义包括河道、航线、船闸、机场、码头、堤防以及水路或航空运输中其他相似结构物；“车辆”一词的涵义包括船舶和飞机等。

The contents of respective items mentioned above of this paragraph are applicable to the transportations of waterway and air transport, among which, the meaning of the word “road” include river-way, airline, navigation lock, wharf, airport, dam and other similar structures in waterway and air transport; the meaning of the word “ vehicle” is inclusive of ship, aircraft and so on.

承包商应采取一切合理的措施，防止承包商或其任何分包商的任何运输 对连接现场的或通往现场的道路或桥梁造成破坏或损伤，承包商特别应该选择运 输线路，选用运输工具，限制和分配载运重量，以便使来往于现场的材料、工程 设备、承包商设备或临时工程运送所不可避免出现的任何这类特殊交通运输受到尽可能合理的限制，从而避免对这些道路和桥梁造成不必要的损害或损伤。

The Contractor shall use every reasonable means to prevent any of the roads or bridges communicating with or on the routes to the Site from being damaged or injured by any traffic of the Contractor or any of his Subcontractors and, in particular, shall select routes, choose and use vehicles and restrict and distribute loads so that any such extraordinary traffic as will inevitably arise from the moving of materials, Plant, Contractor's Equipment or Temporary Works from and to the Site shall be limited, as far as reasonably possible, and so that no unnecessary damage or injury may be occasioned to such roads and bridges.

除合同另有规定外，为了便利承包商的设备或临时工程的运输，承包商 应负责对通往现场或位于通往现场路线上的任何桥梁的加固或道路的改建或改善，并支付其费用，并且应持续保障雇主免于承担由于此类运输造成任何桥梁和道路 损害而引起的一切索赔，包括可能直接向雇主提出的此类索赔，承包商应出面谈 判并支付纯粹由此类损害而引起的一切索赔。

Save insofar as the Contract otherwise provides, the Contractor shall be responsible for the shall pay the cost of strengthening any bridges or altering or improving any road communicating with or on the routes to the Site to facilitate the movement of Contractor's Equipment or Temporary Works and the Contractor shall indemnify and keep indemnified the Employer against all claims for damage to any such road or bridge caused by such movement, including such claims as may be made directly against the Employer, and shall negotiate and pay all claims arising solely out of such damage.
