承包人提供的施工设备和临时设施

Construction Equipment and Temporary Facilities Provided by Contractor

 

承包人应按合同进度计划的要求，及时配置施工设备和修建临时设施。进入施工场地的承包人设备需经监理人核查后才能投入使用。承包人更换合同约定的承包人设备的，应报监理人批准。

The contractor shall, under the requirement of progress schedule hereof, effect without delay allocation of construction equipment and building temporary facilities. The contractor’s equipment which will enter into the work site should be checked and inspected by the supervisor before being put into use. Replacement of the equipment which has been agreed in contract should be approved by the supervisor.

 

除专用合同条款另有约定外，承包人应自行承担修建临时设施的费用，需要临时占地的，应由发包人办理申请手续并承担相应费用。

Unless otherwise stipulated in particular condition of the contract, the contractor shall bear the cost of the construction of temporary facilities on which , if, occupation of land, the employer shall go through the formalities of application and bear the corresponding costs.

发包人提供的施工设备或临时设施在专用合同条款中约定。

Construction equipment and temporary facilities provided by the employer should be stipulated in the particular term.

 

要求承包人增加或更换施工设备

Requirement of Contractor’s Added or Replaced Work Equipment

 

承包人使用的施工设备不能满足合同进度计划和（或）质量要求时，监理人有权要求承包人增加或更换施工设备，承包人应及时增加或更换，由此增加的费用和（或）延误的工期由承包人承担。

Provided that if the work equipment using by the contractor cannot satisfy the progress schedule of contract and / or the quality requirements, the supervisor reserve right to require the contractor add or replace work equipment, for which the contractor should promptly increase or replace thereof, the added cost and / or delayed term arising therefrom will be born by the contractor.

 

材料与设备专用要求

Particular Requirement for Material and Equipment

承包人运入施工现场的材料、工程设备、施工设备以及在施工场地建设的临时设施，包括备品备件、安装工具与资料，必须专用于工程。未经发包人批准，承包人不得运出施工现场或挪作他用；经发包人批准，承包人可以根据施工进度计划撤走闲置的施工设备和其他物品。

The materials, equipment of engineering and execution, which are transported into the site by the contractor, and the temporary construction building by the contractor, include inter alia spare parts, the tools and data for installation should be exclusively used in engineering work, without the approve of the employer, should not be transported out of the site or used for other purpose. The contractor may, through the approval of the employer, withdraw the idle working equipment and other articles pursuant to the progress schedule.

 

承包人根据合同约定或监理人指示进行的现场材料试验，应由承包人提供试验场所、试验人员、试验设备以及其他必要的试验条件。监理人在必要时可以使用承包人提供的试验场所、试验设备以及其他试验条件，进行以工程质量检查为目的的材料复核试验，承包人应予以协助。

Where the contractor, by virtue of the agreement hereof or the supervisor’s instruction, make the material test on site, the place, personnel, device and other necessary conditions for the test should be provided by the contractor. The supervisor may, when necessary, use the places, equipment and other conditions for test which provided by the contractor, to carry out the material review test for the purpose of quality inspection of the project, for which the contractor should effect assistance thereof.

 

承包人应按专用合同条款的约定提供试验设备、取样装置、试验场所和试验条件，并向监理人提交相应进场计划表。

The contractor should, under the agreement of particular condition hereof, provide the test equipment, sampling device, the place and condition for test, in addition to issue the schedule of entry site.

 

承包人配置的试验设备要符合相应试验规程的要求并经过具有资质的检测单位检测，且在正式使用该试验设备前，需要经过监理人与承包人共同校定。

The contractor's test equipment shall conform to the requirements of the relevant test procedures and be checked by a qualified testing unit, and shall be jointly determined by the supervisor and the contractor prior to the official use of the test equipment.

 

拟用于工程的生产设备和材料

Plant and Materials intended for the Works

 

如果根据合同规定,承包商有权获得尚未运到现场的生产设备和材料的期中付款,承包商必须具备下列条件才有权得到:

If the Contractor is entitled, under the Contract, to an interim payment for Plant and Materials which are not yet on the Site, the Contractor shall nevertheless not be entitled to such payment unless:

 

相关生产设备和材料在工程所在国,并已按雇主的指示,标明是雇主  的财产;或

(a)    the relevant Plant and Materials are in the Country and have been marked as the Employer’s property in accordance with the Employer’s instructions; or

 

承包商已向雇主提交保险的证据和经雇主批准的实体按批准的格式签发的、数额和币种与该项付款相同的银行保函.该保函可以用与第14.2款[预付款]中提到的格式相似的格式,并应做到在生产设备和材料已在现场妥善储存并做好防止损失、损害或变质的保护以前一直有效.

(b) the Contractor has delivered, to the Employer, evidence of insurance and a bank guarantee in a form and issued by an entity approved by the Employer in amounts and currencies equal to such payment. This guarantee may be in a similar form to the form referred to in Sub-Clause 14.2 [Advance Payment] and shall be valid until the Plant and Materials are properly stored on Site and protected against loss, damage or deterioration.

 

对于附件A B 和C中没有明确规定的设备、备用件、 材料、 服务或人员，但，根据通行的油田惯例，为了正常的陆地钻井施工，为了承包商钻机及设备的运行和维护，又需要这些设备、备用件、材料、 服务或人员，承包商应自付费用提供这些项目。

CONTRACTOR shall also provide at its expense any items of equipment, spare parts, supplies, services, or Personnel which are not mentioned in Appendices "A", "B" or "C", but which are required for the operation and maintenance of CONTRACTOR’S Rig and equipment for normal onshore drilling operations, according to good oil field practice.

 

本工程项目中，设计人不得指定建筑材料、设备的生产厂或供货商。发包人需要设计人配合建筑材料、设备的加工订货时，所需费用由发包人承担。

12.3 In the projects of the Contract, Designer shall not appoint manufacturers or Designers of construction materials and equipment. Where there is a necessity that Designer shall cooperate with Employer in ordering the process of construction materials and equipment, the relevant charge shall be paid by Employer.

 

 

由于设备制造原因试车达不到验收要求，由该设备采购一方负责重新购置或修理，乙方负责拆除和重新安装，费用由责任方承担。设备由乙方采购的，由乙方承担修理或重新购置、拆除及重新安装的费用，工期不予顺延；设备由甲方采购的，甲方承担上述各项追加合同价款，工期相应顺延。

In case the commissioning is failed due to the manufacture of any equipment, the procuring party of the equipment shall be responsible for reprocurement or repair, and Party B shall be responsible to remove and reinstall at the cost of the responsible party. If the equipment is procured by Party B, Party B shall be responsible for all the expenses on repair, reprocurement, removal and reinstallation without changing the construction period; If the equipment is procured by Party A, Party A shall be responsible for all the expenses as mentioned and extend the construction period accordingly.

 

双方一致同意，如发包人为保证工程质量而指定承包人采购某一厂家的商品时，应由承包人具体与该厂家签订合同，在合同中明确发包人是所供应设备和材料的使用者，配合或监督供应商做好所供设备和材料的安装等工作。在签署此等合同之前，承包人应当将其提交发包人审阅并得到发包人的书面同意。承包人应当对供应商在此等合同项下的安装、质量、维修、售后服务、培训、技术协助等所有义务对发包人承担连带责任。

Both Parties agree that, if in order to guarantee the quality of the Project, the Employer designates the Contractor to purchase the goods of a certain manufacturer, the Contractor shall sign the purchase contracts with the manufacturer, in which the Employer shall be specified as the user of the supplied equipment and materials, cooperate or supervise the supplier to complete the work for the equipment and materials such as installation etc. Before such contracts are signed, the Contractor shall submit them to the Employer for review and obtain the Employer’s written consent on them. The Contractor shall be jointly liable for all the supplier’s obligations under those contracts in respect of installation, quality, repair, safe-sales service, training, technical assistance etc to the Employer.

 

如主要设备需要替换，新公司股东应按其股份比例增加投资额，用以购买和安装替换设备。替换设备和部件的使用年限由国际上接受的会计原则确定，如使用年限超过转让期，替换费应由B和新公司按照超过转让期的年份比例和在转让期的年份比例分担。

In case that main equipment should be replaced， the members of ew Company shall agree to increase their investment amount in the proportion of their share to New Company for the procurement and installation of that replacing equipment. Cost for replacement parts and equipment of which durable year， determined by the internationally accepted accounting principle， exceeds Transfer Date， shall be shared between B and New Company in proportion of the years beyond Transfer Date nd the years falling within Transfer Date.

 

临时工程是指在工程实施、完成和修补其任何缺陷时需要或有关的所有各种临时工程，但承包人的设备除外。

"Temporary works" means all temporary works of every kind (other than Contractor's Equipment) required in or about the execution and completion of the Works and remedying of any defects therein.

 

工程设备是指预定构成或构成永久工程一部分的机械、仪器以及类似设备。

"Plant" means machinery, apparatus and the like intended to form or forming part of the Permanent Works.

 

承包商的设备是指在工程实施、完成及其缺陷修补过程中所需要的全部装置和任何性质的物品，但不包括预定构成或构成永久工程一部分的设备、材料或其它物品。

"Contractor Equipment" means all appliances and things of whatsoever nature (other than Temporary Works) required for the execution and completion of the Works and the remedying of any defects therein, but dose not include Plant, materials or other things intended to form or forming part of the Permanent Works.

 

由于所采购的货物的运行和维护费用是设备使用周期成本的一个主要部分，这些费用将根据投标资料表或技术规格中规定的标准进行评价。

Since the operating and maintenance costs of the goods under procurement form a major part of the life cycle cost of the equipment, these costs will be evaluated in accordance with the criteria specified in the Bid Data Sheet or in the Technical Specifications.

 

承包商根据各分标段的项目实施进度表，分别提供场地的地质勘探；工程的基本设计、设备采购、供货；厂房、设备基础、管网的施工；设备的安装、调试；人员培训；各主生产线的试车、试生产；投产；验收交付。

The Contractor shall provide the site geological survey report, technical design, shop drawing design, equipment purchasing, equipment supply, construction for plant building, equipment foundation as well as piping network, equipment installation, staff training, test run and trial production for main production lines, start up of the production, acceptance test and hand over.

 

施工设备是指由承包商提供并由其在实施合同工程时使用的设备，但工程信息未要求承包商将此类设备用于合同工程上。

Equipment is items provided by the Contractor and used by him to Provide the Works and which the Works information does not require him to include in the works.

 

承包商应按项目经理的指令将施工设备的设计细节提交项目经理认可。项目经理不认可的理由为，该设备使承包商不能根据下列诸项实施合同工程

进口设备除了进口税和增值税之外的所有费用和税款（参考GC14–税费），这些设备构成了发电厂的固定资产。

All of fees and taxes except Import tax and VAT for import equipment (refer to GC 14 – Tax and fee) which constitute the fixed assets of Power Plant.
