Brief Introduction of Two Recent Cases of Discrimination against HBV Carriers in Education Field

A. The discrimination against HBV carrier students in Weinan, Shanxi Province
It was reported on September 11th that 31 students in a vestibule school in Weinan, Shanxi Province were forced to drop out after being checked out their HBsAg positive. The school confirmed the news and believed that the health status of HBV carriers was not suitable for collective life as in the school due to the transmission of Hepatitis B virus. These 31 students were checked out being Hepatitis B carriers in the medical examination after admission. Some of these students have already completed the procedure accompanied by their parents and left.
The report was posted on the e-mal lists and websites for HBV carriers and aroused indignation among the community. Calls and emails were made toward the school, expressing their anger to the wrong-doing from the school and the attention to the follow-up development.
Under continuous pressure, the school changed their decision and announced on their website that those who already left school had been noticed back to school and there was going to be a HBV-DNA test for these 31 students. The resolution will correspondingly be different, either continue to study or leave for further treatment.
Several days later, 31 students accepted the HBV-DNA test at the local CDC. 13 of them were forced to drop out for further treatment till their DNA test return to a limited level. These 13 students have left school and cut off the contact with outside.

B. The discrimination against Hepatitis B carrier student in Graduate Enrolment Exam
China Art Academy is accused of conducting discrimination against HBV student in its graduate admission. Wenjie, an HBV carrier with a normal liver function, was rejected by the Graduate School of China Art Academy in this April for carrying Hepatitis B virus.
Wenjie, who took the Graduate Enrolment Exam in January and the re-examination in April ranked the second among 21 applicants. However, he was refused on the ground of his physical examination simultaneously carried out with the re-examination. He was told after the second physical test on HBV-DNA that his HBV-DNA testing result has fallen out of the given level by the Academy and the Academy can not accept him.
This case has been submitted to Chaoyang District Court in last week. But the court refused to file, the court even refused to accept the condescendence. Moreover, the student and his lawyer were detained for one hour and a half by the court.
