As a NGO on behalf of 1.6 million HBV carriers in DongGuan, GuangDong Province, DongGuan “Heart to Heart” Working Group seriously express our strong condemnation and indignation to one of your factories in DongGuan. The factory committed a wrongdoing of compelling all the employees to take HBV examination, the action of which is forbidden by law. Now we hope you headquarters can carry out an investigation to the incident and rectify the wrongdoing of the factory. Most of all, you are expected to take effective measures to put and end to similar incidents.

On July 30, 2008, DongGuan branch issued a notice that all employees were scheduled to take a physical examination including chest X ray and HBVM on August 3 and that anyone who was unwilling to take the examination would be regarded to quit. We got this information two days before the examination and we advised the factory to stop this illegal action, because any HBV examination that is not medically necessary is in violation of the Chinese law and the EICC, the acknowledged conduct of electronic trade. It was a pity that the company conducted the physical examination as scheduled, regardless of the law and the privacy of  all the employees. The company even published an announcement that anyone who did not take the examination would be made public and the company would not renew the labor contract at the expiration of it.

On the examination day, a volunteer of Heart to Heart, together with the reporters of Guangzhou Daily Tang Hongjie and Xie Huaxing, went to the factory, trying to persuade Xiao Jian, the HR manager, to stop the examination. They tried to explain patiently to the HR manager. However, something beyond everyone’s imagination happened. As one of the top management, the HR manager resorted to violence­: he grabbed the volunteer around the neck!

We are astonished at the rude deeds of your manager and we retain the right to claim for damages. Guangzhou Daily and some local websites covered this incident. For any detail, please make reference to:

The wrongdoing of Your Dongguan Branch has rudely invaded the privacy of all the employees and violated the EICC and the Chinese law.  At this time, have to doubt whether your company is one that complies with the law and one that respects human rights as you claimed and one that takes its responsibility?

On behalf of the 1.6 million HBV carriers in DongGuan, we seriously demand you headquarters in America& Taipei to investigate the wrongdoing of compelling HBV examination and the violent behavior of the HR manager. We seriously advise you to take effective measures to protect the privacy and equality of the HBV carriers in the employees. We strongly suggest you headquarters to value your reputation and undertake your social responsibility.

We retain the right to claim for damages to the local Labor Inspection Team and the Court.

It is an international usage and the provision of Chinese law that HBVM test and HBV discrimination are forbidden in work places. However, we are regretted to see that Dongguan Branch of ATLCONNECT, your wire supplier, conducted a compelling HBV examination on their employees. We would be appreciated if you could press ATLCONNECT to reflect on its wrongdoing and take immediate steps to correct it. 

 

We at the same time remind you headquarters to take the cooperative relationship between you two companies into account seriously.

 

We will keep our constant deep concern over this incident.
