薛捍勤法官当选记录

薛捍勤大使刚刚当选国际法院法官。她获得联大的152票中的150票赞成。哪不赞成的家伙是谁?

就专业能力而言,薛法官可能是倪征(日奥)之后中国派出的最强的一位了。她在国际法方面的专业知识和实践经验极强。

2008年我在日内瓦时,薛法官(当时还是薛大使)以联合国国际法委员会委员的身份在日内瓦开会,承蒙她提携后辈,给我办了一个联合国出入证,带着我以中国委员助理的身份参加国际法委员会的会议,让我见到了当今国际法学界的诸位超级大腕,包括已经故去的Ian Brownlie. 在1999年参加联合国国际贸易法委员会的会议之后,我又一次凭证件混进联合国。

General Assembly Elects China’s Xue Hanqin to Serve as Judge

 

on International Court of Justice until February 2012

 


In one round of balloting today, the General Assembly elected Xue Hanqin (China) as a member of the International Court of Justice, in an election run independently of but concurrently with the Security Council.


Ms. Xue, who will be in office until 5 February 2012, will complete the unexpired term of Judge Shi Jiuyong ( China), former Vice-President and President of the Court, whose resignation took effect on 28 May.  Elected to the Court on 10 November 1993 and re-elected on 21 October 2002, Mr. Shi’s term would have expired on 5 February 2012.


The Court’s justices are elected by obtaining an absolute majority of votes in both the Assembly and the Council, without regard to their nationality, from among persons of high moral character around the world.  For the present election, 97 votes constituted an absolute majority.  (For election results from the Security Council, please see Press Release SC/9964)


Taking account of Mr. Shi’s resignation, the Court is now composed of President Hisashi Owada ( Japan) and Vice-President Peter Tomka ( Slovakia), whose terms of office expire on 5 February 2012.  Its Judges are Ronny Abraham (France), Awn Shawkat Al-Khasawneh (Jordan), Mohamed Bennouna ( Morocco), Thomas Buergenthal ( United States), Antônio Augusto Cançado Trindade ( Brazil), Christopher Greenwood ( United Kingdom), Kenneth Keith ( New Zealand), Abdul G. Koroma ( Sierra Leone), Bernardo Sepúlveda-Amor ( Mexico), Bruno Simma ( Germany), Leonid Skotnikov ( Russian Federation) and Abdulqawi Ahmed Yusuf ( Somalia).


Voting Results


In one round of voting, the General Assembly today elected Xue Hanqin ( China) to the International Court of Justice, to fill a seat vacated by Shi Jiuyong ( China).

Security Council Elects Xue Hanqin of China to International Court of Justice,

 

in Tandem with General Assembly, to Serve Until 5 February 2012

 


In a vote held simultaneously with the General Assembly, the Security Council today elected Xue Hanqin of China, by secret ballot, to the International Court of Justice to fill the remainder of the term left vacant by the resignation of Judge, Vice-President and former President of the Court, Shi Jiuyong of China.


Ms. Xue, Chinese Ambassador to the Association of Southeast Asian Nations (ASEAN), Legal Counsel to the Ministry of Foreign Affairs of China, and member of the International Law Commission, will serve until 5 February 2012.


In the course of their separate meetings, the two bodies — the Security Council and General Assembly — exchanged information about the results of their respective votes, revealing that Ms. Xue received an absolute majority of votes in both organs — 15 votes in the case of the Council. 


[According to the rules of procedure, members of the International Court are elected by both the General Assembly and Security Council, acting independently of one another.  When a candidate has obtained the required majority in one of the organs, the President of that organ notifies the President of the other of that result.  If the result is different, the Assembly and Council continue voting, up to three times if necessary, until both bodies have given an absolute majority of votes to the same candidate.


If, after the third meeting, the vacancy still remains unfilled, Member States may resort to a special procedure set out in the Statute of the Court, at the request of either the Assembly or the Council. 


By that procedure, a joint conference consisting of three Assembly members and three Council members will vote for a candidate.  If the joint conference is satisfied that it will not be successful in procuring an election, members of the Court shall, within a period to be fixed by the Security Council, proceed to fill the vacant seats by selection from among those candidates who have obtained votes either in the Assembly or the Council.  In the event of an equality of votes among the judges, the eldest judge shall have a casting vote.]


The meeting began at 10:19 a.m., was suspended at 10:29 a.m. for counting, resumed at 10:58 a.m. and ended at 11:05 a.m.
