Article 2 Contracting Scope 

 

乙方根据自来水公司和规划局批复的方案，设计供水管网并按设计图纸施工。乙方应当按本工程施工图纸所规定的项目施工。

Party B shall, based on the program approved by the water supply company and the Planning Bureau, design the water supply pipe network and make construction pursuant thereto. Party B shall construct the project In accordance with the items specified in the construction drawings of the project.

 

第三条 承包方式及安装要求

Article 3. Contracting methods and installation requirements

 

（1）本工程采用包税费、包工包料、包设计、包施工、包包装、包工期、包质量、包安全、包通过甲方及自来水公司验收的承包方式。双方同意按下列第      种方式执行：

 (1) The contracting method adopted for this project is including tax, material, design, construction, packaging, work period, quality, safety and acceptance by Party A and the water supply company. The parties agree to proceed in the following manner of      :

 

1）  双方审定的工程造价由乙方进行一次性大包干。

2）  The cost of the project as confirmed by the parties shall be lump sum for Party B’s construction.

 

2）工程量按经规划局和自来水公司批复的施工图纸计算，图纸外工程量按工程师的实际施工测量确认，材料及设备价格经甲方审定后予以结算，其他项目措施费、包干费、设计费不再另计。

(2) The bill of quantities will be calculated subject to the construction drawings approved by the Planning Bureau and the water company, the bill of quantities beyond the drawings is confirmed by the engineer's actual construction measurements, the price of materials and equipment will be settled upon Party A's validation, and the cost of other items of measures, lump sums, and design fees will not be calculated separately.

 

（3）安装要求：按照国家有关供水安装标准及自来水公司的供水管及水表安装要求。

(3) Installation requirements: in accordance with the State’s standards of relevant water supply installation, in addition to the installation requirements of water supply pipe and water meter by the water supply company.

 

（2）如遇下列情况，乙方须在发生签证事由     日内书面通知甲方，并经甲乙双方代表签证，工期可相应顺延；否则视为乙方放弃签证的权利，工期不予顺延：

(2) In case of the following circumstances, Party B shall notify Party A in writing within

      days of the occurrence of the matter with the cause of the signing confirmation, and the construction period can be postponed accordingly by the parties hereto’s signing confirmation, otherwise, it is regarded as Party B giving up the right of the signing confirmation and no  construction period will be postponed:

 

（1）乙方应当严格按照施工图、说明书以及国家有关规定、施工技术规范和自来水管道操作安装规程进行施工，做好试件和材料的试验和报验，确保工程质量，并按期完工。

(1) Party B shall carry out the construction in strict accordance with the construction drawings, specifications and State’s relevant regulations, working technical specifications and the procedures of water pipeline operation and installation, and do a good job in testing and inspection of test pieces and materials to ensure the quality of the project and complete the project on schedule.

 

（2）乙方应当接受甲方对工程质量的监督。如果甲方发现主要进度延误，或主要工程存在重大质量问题，甲方以书面形式通知乙方，乙方应当在收到甲方书面通知后     日内采取有效措施纠正。

(2) Party B’s project quality shall be subject to Party A's supervision. Party A, if finds delay of the main progress or major quality problems in the main works, shall notify in writing Party B which should take effective measures to rectify the situation within      days upon receipt of Party A's written notice.

 

2．验收 2. Acceptance

（1）工程竣工验收应以施工图纸、说明书、图纸会审记录、有关变更的书面文件、国家颁发的施工验收规范和质量检验标准为依据。

(1) The completion acceptance of the project should be based on the construction drawings, specifications, drawing review records, written amendment documents, the State-issued construction acceptance norms and quality inspection standards.

 

第六条 工程总价款及付款方式

Article 6 Total project price and payment method

 

（1）工程预算总价款为人民币      元（大写     ），工程竣工后按实际工程量结算，实际工程量以甲乙双方验收依据及共同签证为准。当工程项目变更较大时．甲乙双方应及时对工程预算总价款进行调整，并以调整后的工程预算总价款作为支付进度款的依据。

(1) The total budget price of the project is      RMB yuan (      in word), and the project will be settled under the actual bill of amount upon completion, and the actual quantity of work shall be subject to the acceptance and mutual confirmation of the parties. The larger amendment shall be adjusted by party A and B without delay and the adjusted total project budget price will be taken as the basis for the payment of the progress payment.

 

（2）本工程的总价款不含市政路面修复费，不含供水主干管分摊费。

(2) The total price of this project shall be exclusive of the fees of municipal road repair and apportionment fee of the water supply trunk.

 

（1）甲方委派的现场代表（工程设计部门） 负责对工程建设进行全面管理，处理施工过程中出现的需要甲方协调的相关事项，并参与工程各种验收和签证工作。如涉及变更事项，现场代表应及时通知乙方。

(1) The on-site representative (engineering design department) appointed by Party A is responsible for the overall management of the construction, dealing with relevant matters requiring Party A's coordination during the construction process, and participating in various acceptance and confirming works of the project. If amendments are involved, the on-site representative shall notify Party B in time.

 

（2）向乙方提供施工场地，保证运输道路畅通，同时提供施工现场用水、用电（水电费由乙方承担）。

(2) To provide Party B with the construction site, ensure the transportation road smooth, and provide water and electricity for the construction site (the costs there shall be accountable on Party B).

 

（3）提供本项目施工图，组织图纸会审和设计交底。

 (3) Provide construction drawings of the project and organize drawing review and design disclosure.

 

（4）及时对工程进度、工程质量进行监督检查，参加材料报验，组织工程的初验，在收到乙方书面通知起4个工作小时内参加隐蔽工程验收。

(4) To make supervision and inspection, without any delay, of the progress and quality of the project, participate in the inspection of materials, organize the initial inspection of the project, and participate in the acceptance of concealed works within 4 working hours upon the receipt of Party B's written notification.

 

2．乙方义务

2. Party B's obligations

 

（1）委派现场代表负责施工期间的全面管理。该现场代表须持有与本工程项目相适应的资格证书。如变更现场代表应事先经甲方书面同意。

(1) To dispatch the on-site representative which with the qualification certificate suitable for the project to be responsible for the overall management during the construction period, and no replacement thereof without Party A’s prior written consent.

 

（2）根据甲方确认的施工图纸，按照本合同约定完成承包范围内的施工，并按甲方要求的格式书面提请办理验收和确认手续。

(2) should, in accordance with the construction drawings confirmed by Party A, complete the construction within the scope of the contract pursuant to the agreement hereof, and submit the written request for acceptance and confirmation procedures in the format required by Party A.

 

（3）工程项目开工应提前      个工作日将完整的施工组织设计、网络图和施工技术措施以及工程主要负责人名单报甲方确认、备案，如乙方更换工程主要负责人，应事先征得甲方书面同意。

(3) The complete construction organization design, network diagram, construction technical measures and the list of main persons in charge of the project shall be submitted to Party A for confirmation and record      working days in advance of the commencement of the project. Any replacement by Party B of the main person in charge of the project shall be subject to Party A's prior written consent.

 

（4）乙方材料进场前，须提前     个工作日书面通知甲方，进场时经双方共同验收并作书面记录。

(4) Party B shall notify Party A in writing prior      working days upon entry of the materials into the site, and make the written record of acceptance by the parties at the time of entering the site.
