第三条 工程监理

Article III. Project Supervision

 

若本工程实行工程监理，甲方与监理公司另行签订《工程监理合同》，并将监理人员的姓名、单位、联系方式及职责等在开工前通知乙方。

Provided that the supervision will be conducted on the project, Party A and the supervising company shall sign a separate Contract of Project Supervision and, prior to the commencement of the project, notify Party B of the names, units, contact details and duties of the supervisors.

 

第四条 施工配合

Article IV. Construction Cooperation

 

一、甲方义务：

1. Party A’s obligations:

 

（一）提供房屋原始图纸等相关文件。

(1) Provision of the original drawings of the house and other relevant documents.

 

（二）需在地面上有特殊要求的，预先向乙方提出，以便乙方采取预留措施；开工前，在乙方指导下完成以下工作：清空并整平地面、打通墙面管道通孔、使线缆管路不暴露于地面、对室内陈设归堆和遮盖、提供符合施工条件的水源、电源、气源。

(2) Any special requirement for the ground works should be raised with Party B in advance so that Party B can take precautionary measures therefor. Prior to the commencement of work, the following work shall be completed under the guidance of Party B: clearing and levelling the ground, opening up the wall pipeline through-holes, keeping the cables and pipelines off the ground, stacking and covering the indoor furnishings, and providing water, power and gas sources in accordance with the construction conditions.

 

（三）保护乙方已施工完成的部分。

(3) Protection of the construction part completed by Party B.

 

（四）参与工程质量和施工进度的监督，负责材料进场验收、隐蔽工程验收及工程竣工验收。

(4) Participating in the supervision of the quality of works and construction progress, and be responsible for the acceptance of materials on site, acceptance of concealed works and works completion.

二、乙方义务：

2. Party B’s obligations:

 

（一）施工中严格执行安全施工操作规范、防火规定、施工规范及质量标准，按期保质完成工程。

(1) Strictly enforce the code, during construction, of practice for safe construction, fire prevention regulations, construction specifications and quality standards, and complete the works on time and with quality.

 

（二）保护好原居室室内的家具和陈设，保证居室内上、下水管道的畅通。

(2) Protection of the furniture and furnishings in the original apartment and ensure the indoor plumbing and drainage pipes are unobstructed.

 

（三）保证施工现场的整洁，工程完工后负责清理施工现场。

(iii) Ensuring the tidiness of the construction site and be responsible for cleaning up, upon completion of the works, the construction site.

第五条 工程质量和验收

Article 5 Quality and acceptance inspection of project

 

一、本工程质量标准按下列第     项执行。

1. The quality standard of the work shall be in accordance with item      below.

 

（一）执行现行工程建设规范《地面辐射供暖技术规程》，上述规范未涉及的项目按国家现行的相关标准执行。

(1) Implementation of the current engineering and construction code Technical Regulations for Radiant Floor Heating, and items not covered by the above code will be implemented in accordance with the relevant State’s standards in force.

 

（二）按双方约定的标准执行。

(2) Implementation of the standards agreed upon by both parties.

 

二、施工过程中，甲方提出变更修改设计、增减工程项目或者变更材料设备，须提前与乙方联系，签订《工程项目变更单》（见附件四）后方能进行施工。

2. Provided that Party A, during the construction process, proposes amendments of modifying the design, increase or decrease the project items or change the material and equipment, it should, prior to carrying out the construction, contact Party B in advance and sign the Project Change Order (refer to Annex IV).

 

三、双方约定在施工过程中分下列几个阶段对工程质量进行验收，乙方应提前      天通知甲方，阶段验收合格后应填写《工程质量验收保修单》（见附件五）：

3. The parties hereto agree to accept the quality of the project in the following stages during the construction process, Party B shall notify Party A in advance by     days, and shall fill in the Warranty Form of Project Quality Acceptance (refer to Annex V) subsequent to passing the stage acceptance.

 

（一）设备材料验收；

(1) Acceptance of equipment and materials.

 

（二）隐蔽工程验收；

(2) Acceptance of concealed works.

 

（三）工程竣工验收。

(3) Acceptance of the completion of the works.

 

四、工程竣工后，甲方验收通过的，乙方向甲方提供《工程质量验收保修单》（见附件五），同时提供管线竣工图等资料，并办理验收移交手续。

4. Party B will, upon passing the acceptance subsequent to the work’s completion, provide Party A with the Warranty Form of Project Quality Acceptance (refer to Annex V), in addition to other data, and handle the acceptance handover procedures.
