预付款担保书
GUARANTEE FOR ADVANCE PAYMENT

根据         （承包人名称）（以下称“承包人”）与       （发包人名称）（以下简称“发包人”）于      年    月    日签订的      （项目名称）        标段施工承包合同，承包人按约定的金额向发包人提交一份预付款担保，即有权得到发包人支付相等金额的预付款。我方愿意就你方提供给承包人的预付款提供担保。
According to the contract for section construction         signed by      ( the name of the contractor ) (hereinafter referred to as " the contractor" ) and      ( the name of the employer ) (hereinafter referred to as " the employer" ) on      ( the project name ), the contractor shall submit an advance payment guarantee to the employer according to the agreed amount, that is, the contractor shall have the right to receive an advance payment equal to the amount paid by the employer. We are willing to guarantee the advance payment you provide to the contractor.

2. 担保有效期自预付款支付给承包人起生效，至发包人签发的进度付款证书说明预付款已完全扣清止。
The guarantee is valid from the time the advance payment is paid to the contractor until the progress payment certificate issued by the employer indicates that the advance payment has been fully deducted.

3. 在本保函有效期内，因承包人违反合同约定的义务而要求收回预付款时，我方在收到你方的书面通知后，在７天内支付。但本保函的担保金额，在任何时候不应超过预付款金额减去发包人按合同约定在向承包人签发的进度付款证书中扣除的金额。
During the validity period of this guarantee, where the contractor demands to recover the advance payment due to breach of the obligations stipulated in the contract, we shall pay within 7 days after receiving your written notice. However, the guarantee amount of this guarantee shall not exceed the advance payment amount at any time minus the amount deducted by the employer in the progress payment certificate issued to the contractor as agreed in the contract.

4. 发包人和承包人按《通用合同条款》第15条变更合同时，我方承担本保函规定的义务不变。
Where the employer and the contractor change the contract according to article 15 of the general conditions of contract, our obligations under this guarantee will remain unchanged.
