AGREEMENT OF ENGINEERING QUALITY WARRANTY

发包人、承包人根据《中华人民共和国合同法》、《建设工程质量管理条例》和《铁路建设管理办法》，经协商一致，对      （项目名称）第      标段      （起讫里程范围）工程签订工程质量保修协议书。
In accordance with Contract Law of the People's Republic of China, the Regulations on the Quality Management of Construction Projects, and the Measures for the Administration of Railway Construction, the employer and the contractor agree and sign the Warranty agreement on the project quality for the project      in the (tender name)     section (starting to final range).

一、工程质量保修范围和内容Scope and content of the engineering quality warranty

承包人在质量保修期内，按照有关法律、法规、规章规定和双方约定，承担本工程质量保修责任。
The contractor shall, during the quality warranty period, be responsible for the quality warranty of this project in accordance with the relevant laws, regulations, rules, regulations and the agreement between the two parties.

质量保修范围包括       工程，以及双方约定的其他项目。具体保修的内容，双方约定如下：

二、质量保修期  Quality warranty period

工程质量保修期按国家法律法规、行业规定和设计文件规定的合理使用年限执行，质量保修期自工程竣工验收合格之日起计算。承包人及其人员对工程质量终身负责。
The quality warranty period of the project is implemented in accordance with the reasonable service life stipulated by national laws and regulations, industry regulations and design documents. The quality warranty period is calculated from the date when the project is completed and accepted. The contractor and his staff are responsible for the quality of the project for life.

三、质量保修责任Quality warranty responsibility

1.属于保修范围、内容的项目，承包人应当在接到保修通知之日起７天内派人保修。承包人不在约定期限内派人修补的，发包人可以委托他人修补。

For items that fall into the scope and content of the warranty, the contractor shall send worker for  warranty within 7 days from the date of receiving the warranty notification. If the contractor fail to send worker to repair within the agreed time limit, the contractor may entrust others to do so.

2. 发生紧急抢修事故的，承包人在接到事故通知后，应当立即到达事故现场抢修。
In the case of an emergency repair accident, the contractor shall immediately arrive at the accident site for repair upon receipt of notification of the accident.

3.对于涉及结构安全的质量问题，应当按照铁路建设工程质量保修的有关规定，立即向当地铁路行政主管部门报告，采取安全防范措施；由原设计单位或者具有相应资质等级的设计单位提出保修方案，承包人实施保修。

For quality issues that involve structural safety, they should immediately report to the local railway administrative authority in accordance with the relevant provisions of the railway construction project quality warranty and take safety precautions; the original design unit or the design unit with the corresponding qualification level shall propose a warranty plan. The contractor implements the warranty.

4.质量保修完成后，由发包人组织验收。
The contractor will, upon completion of the quality warranty, organize the acceptance thereof.

四、保修费用Warranty costs

保修费用由造成质量缺陷的责任方承担，给发包人造成损失的，应承担赔偿责任。
The cost of the warranty shall be borne by the party responsible for the quality defect, and any loss to the contractor shall be liable for compensation.

五、其他Miscellaneous
双方约定的其他工程质量保修事项：

本工程质量保修书，由发包人、承包人双方在竣工验收前共同签署，作为合同附件，其有效期限至保修期满。
The quality guarantee of this project is signed by the employer and the contractor before completion and acceptance, which as annex to the contract and the validity period hereof is up to  end of the warranty period.
