要求惠普公司对其代工商泰金宝(苏州)公司解聘22位乙肝携带者事件做出反应的联名信

惠普公司、BSR公司:
2006年年底,贵公司的代工厂——泰金宝光电(苏州)有限公司(以下简称“泰金宝”),对员工强制进行了乙肝病毒标志物检测,并将查出的22名乙肝病毒携带者员工集体解聘。我们强烈谴责这一违背企业社会责任、违背人类基本道德、违犯法律的严重侵犯公民平等就业权的行为!
中国卫生部2006年9月2日发布文件指出:“日常生活和工作接触不会传播乙肝病毒”、“乙肝病毒携带者在工作和生活能力上同健康人没有区别”、“乙肝病毒携带者在生活、工作、学习和社会活动中不对周围人群和环境构成威胁,可以正常学习、就业和生活。”
劳动保障部和卫生部2007年5月18日联合发出《关于维护乙肝表面抗原携带者就业权利的意见》,规定除国家法律、行政法规和卫生部规定禁止从事的易使乙肝扩散的工作外,用人单位不得以劳动者携带乙肝表面抗原为理由拒绝招用或者辞退乙肝表面抗原携带者。
《中华人民共和国传染病防治法》第十六条规定:“任何单位和个人不得歧视传染病病人、病原携带者和疑似传染病病人。”
我们还注意到,在电子行业行为准则(EICC)中规定,“不得进行可能被用于歧视的医学检查。” (workers or potential workers should not be subjected to medical tests that could be used in a discriminatory way.),同时,EICC还规定:EICC的不歧视条款和其他规范一样,不仅对EICC的成员公司起约束作用,而且也是对其供应商、分包商的基本要求。
我们发现,EICC是由惠普发起的制定的,而泰金宝公司是惠普的供应链,因而泰金宝也必须遵守EICC的规定。
然而,我们遗憾地看到,此次泰金宝公司解聘22位乙肝病毒携带者的恶劣事件被曝光已经接近半年,泰金宝公司没有做出任何弥补过错、弥补伤害的举动,惠普公司也对此事件无动于衷。
我们不知道,惠普公司是不是要继续无视自己的代工商严重歧视乙肝携带者的行为?
我们不知道,惠普公司是不是要带头破坏自己发起订立的EICC?
目前,被迫离职的22名员工中的三位已经向江苏省吴江市人民法院提交起诉材料,控告泰金宝公司歧视乙肝病原携带者,要求撤销双方签订的《劳动合同协议解除书》,履行劳动合同,并向被告索赔精神损害赔偿金共计50万元人民币。我们支持这三位员工依法维护自身权益的正义行动!
对于此次惠普公司代工商泰金宝公司解聘22位乙肝病毒携带者的恶劣事件,我们要求惠普公司:
1、要求惠普公司公开谴责其代工商泰金宝光电(苏州)有限公司的严重乙肝歧视行为,并加强对泰金宝的稽核,并且按照EICC准则,要求泰金宝遵守国家法律,切实履行EICC的不歧视条款。
2、如果泰金宝公司不能尽快妥善处理此次歧视事件,不能采取积极措施弥补过错、弥补伤害,我们要求惠普公司终止与泰金宝公司的一切合作。

Joint Letter to Claim for HP’s Reaction to the event of the illegal dismiss of 22 employees with hepatitis B virus by Cal-Comp Electronics and Communications (Suzhou) Company Ltd.
HP headquarters、BSR::
At the end of 2006, your OEM - Cal-Comp Electronics and Communications (Suzhou) Company Ltd. (hereafter called as Cal-Comp), forced its employees to have a hepatitis B virus serum test and dismissed 22 employees with hepatitis B virus accordingly. We strongly condemn Cal-comp’s behavior as infringing the equal working rights of the citizens by breaching the corporate social responsibility and the basic human morality, and going against the current laws.
It is stated in the file released by Ministry of Health of China on Sep 2, 2006, “hepatitis B virus will not be transmitted in casual life and work”, “there is no difference in working and living capability between HBV carriers and average healthy people’’, “HBV carriers are not threat to the surrounding people and environment when living, working, studying and socializing. They can study, work and live as normal.”
The file “Opinions on Protecting the Working Rights of HBV Carriers” released jointly by the Ministry of Labor and Social Security and the Ministry of Health on May 18, 2007, sets down the rule that except for the work prone to the spread of HBV which is forbidden for HBV carriers by the laws, administrative regulations and regulations made by the Ministry of Health, the employer units are not allowed to refuse the employment or dismiss HBV Carriers for the reason of carrying HBV.
Article 16 of “PRC Law of Prevention and Treatment of Infectious Diseases” states: “No units or individuals shall discriminate infectious disease patients, pathogen carriers and suspected infectious disease patients.”
We also notice, in the regulation of Electronic Industry Code of Conduct (EICC), “workers or potential workers should not be subjected to medical tests that could be used in a discriminatory way”. In addition, EICC also says, the non-discrimination clause of EICC has the same applicability as other regulations that it is not only the obligation of its members but also the basic requirement to their suppliers and sub-contractors.
We find HP is one of the initiators of EICC. Because Cal-Comp is the supplier of HP, it must abide by the regulations of EICC.
But we feel regretful that, although the exposure of the black deeds of dismissing 22 HBV carriers has happened for nearly half a year, Cal-Comp has not made any remedies to change their mistake, compensate the damage, and HP headquarter also has not made any reactions.
Whether HP wants to continue your ignorance for the severe discrimination against HBV carriers done by your OEM? We have no idea.
Whether HP wants to break EICC which is initiated by you? We have no idea.
Currently, three of the 22 forced dismissed employees have brought an accusation to People’s Court of Wu Jiang City in Jiang Su Province. They accused Cal-Comp of the discrimination against HBV carrier. They asked for the cancellation of “The Contract on Termination of Labor” and continuation to fulfill Labor Contract, and claimed for compensation for mental damage in total 500 thousand RMB. We firmly support their action of justice for protecting their legal rights!
We earnestly ask for the following reactions from HP for this serious event of dismissing HBV carriers made by Cal-Camp Company Ltd.:
1. HP should openly condemn the severe discrimination against HBV carriers made by its OEM - Cal-Comp (Suzhou) Co. Ltd. In addition, HP should also strengthen your review on Cal-Comp, in line with EICC, and request Cal-Comp to abide by laws and practically perform the non-discrimination clause of EICC.
2. If Cal-Comp can not deal with this discriminatory event properly as soon as possible, and fail to take active measures to remedy their mistake and damage, we ask HP to terminate all your cooperation with Cal-Comp.
