65. BIMCO Double Banking Clause

(a) The Charterers shall have the right, where and when it is
customary and saft for vessels of similar size and type to do so,
to order the Vessel to go, lie or remain alongside another vessel
or vessels of any size or description whatsoever or to order such
vessels to come and remain alongside at such safe dock, wharf,
anchorage or other place for transhipment, loading or discharging
of cargo and/or bunkering.
(b) The Charterers shall pay for and provide such assistance
and equipment as may be required to enable any of operations
mentioned in this clause safely to be completed and shall give the
Owners such advance notice as they reasonable can of the details of
any such operations.
(c) Without prejudice to the generality of the Charterers'
rights under(a) and (b), it is expressly agreed that the Master
shall bave the right to refuse to allow the Vessel to perform as
provided in (a) and (b) if in his reasonable opinion it is not safe
so to do.
(d) The Owners shall be entitled to insure any deductible
under the Vessel's hull policy and the Charterers shall reimburse
the Owners any additional premium(s) required by the Vessel's
Underwriters and/or the cost of insuring any deductible under the
Vessel's hull policy.
(e) The Charterers shall further indemnify the Owners for any
costs, damage and liabilities resulting from such operation. The
Vessel shall remain on hire for any time lost including periods for
repairs as a result of such operation.
船靠船装卸作业的加保费
在目前使用的International Hull Clauses(01/11/03),
第10.4条款是禁止船东在海上船靠船进行装卸作业的,除非得到保险商的同意。有关条文是这么说的:"Unless and to the
extent otherwise agreed by The Underwriters in accordance with
Clause 1...10.4 the vessel shall not be employed in trading
coperations which entail cargo loading or discharging at sea from
or into another vessel(not being a harbour or inshore
craft)."
但是由于船舶越来越大,经常进不了港口而要在公海把货物卸到另一艘比较小的船舶上,导致海上船靠船的装卸作业越来越多。这以来,船东为了不影响船壳险,就只能尽快去于保险商取得同意,而同意的代价往往是支付加保费或提高免赔额(例如从原来的15万美元提高到150万美元)。明智的船东会在期租合同中加入以上附加条款去针对这种船靠船作业。
如果租约在NYPE货其他期租合同下没有针对这一情况的附加条款,也不存在贸易区条款下的限制,仲裁庭一般会认为今天船靠船作业没有什么不合理,所以会判承租人有权这么做,没有违约,不必负担船东的加保费。船东要明确不允许船靠船作业,最安全与肯定的方法是有一条明示的条款不准这样作业或不准任何不寻常作业(如直升飞机)
