就在全世界注意力还都在世界杯开幕的时候,钢铁侠Elon Musk又干了一件惊天地泣鬼神的事情。他正式宣布把Tesla的所有专利全部开源共享!这意味着世界上所有的车企和有想法的个人都可以使用他们的技术来制造电动车。

我们当初创立特斯拉就是为了促进可持续运输工具的发展。虽然我们造出了激动人心的全新电动汽车,但是如果我们随后设立起一系列专利壁垒防止后来者加入,那我们就完全背离了当初创立时的初衷。我们今后不会起诉任何善意使用我们技术的人。(注:恶意的山寨肯定还是不能放过的,你懂的)


当年我创立第一家公司Zip2的时候,我觉得专利是一个好东西,并且努力去申请许多。但是现在时代变了,专利的存在更保护了那些巨头,通过法律措施来让他们越来越富有,而并非真正保护了那些创造者们。所以自从Zip2之后,我意识到获得专利只不过是让你获得了一张可以打官司的彩票之后,我就尽可能不去申请专利了。(注:他的私人太空企业的SpaceX的那些航天技术也是完全没申请专利,Elon当年说他的技术如果被抄袭也是那些巨头国家*你懂的*,所以就算被抄袭也完全没法去争取权利,所以索性放弃了。)


在特斯拉,我们起初比较担心那些汽车巨头们会抄袭我们的技术并用于商业制造,然后他们会用他们的市场,销售,制造能力来打败我们。但我们发现我们完全错了。事实上,非常不幸的事实却恰恰相反,电动车和新能源车对于巨头们来说几乎是忽略不计的,从销售来说连他们1%的销售额都达不到。


那些车企巨头们最多也只是造了一些只能短途,而且数量不多的新能源车。还有一些更本就完全没有造零排放车。


目前美国汽车年产1亿辆,全球大概是20亿辆。对于特斯拉来说完全没有办法能够迅速制造足够的电动车来解决碳排放问题。同时,这也意味着这个市场非常巨大。我们真正的那些竞争者不是巨头们那些小打小闹的电动车产品,而是每天从他们工厂中产出的巨量汽油车。


我们相信特斯拉,其他电动车厂和整个世界都会从一个通用,能快速升级的科技平台中获得获益。


科技领导力从来不是通过专利来实现的。而历史也反复证明了一家公司只有通过吸引和激发世界上最有天赋工程师们的创造力才能保持领先,专利对于对抗竞争者只能起到很小的保护作用。我们相信通过这次的专利开源行动,特斯拉不但不会被打败,反而会变得更强大。

All Our Patent Are Belong To You


Yesterday, there was a wall of Tesla patents in the lobby of our Palo Alto headquarters. That is no longer the case. They have been removed, in the spirit of the open source movement, for the advancement of electric vehicle technology.


Tesla Motors was created to accelerate the advent of sustainable transport. If we clear a path to the creation of compelling electric vehicles, but then lay intellectual property landmines behind us to inhibit others, we are acting in a manner contrary to that goal. Tesla will not initiate patent lawsuits against anyone who, in good faith, wants to use our technology.


When I started out with my first company, Zip2, I thought patents were a good thing and worked hard to obtain them. And maybe they were good long ago, but too often these days they serve merely to stifle progress, entrench the positions of giant corporations and enrich those in the legal profession, rather than the actual inventors. After Zip2, when I realized that receiving a patent really just meant that you bought a lottery ticket to a lawsuit, I avoided them whenever possible.


At Tesla, however, we felt compelled to create patents out of concern that the big car companies would copy our technology and then use their massive manufacturing, sales and marketing power to overwhelm Tesla. We couldn’t have been more wrong. The unfortunate reality is the opposite: electric car programs (or programs for any vehicle that doesn’t burn hydrocarbons) at the major manufacturers are small to non-existent, constituting an average of far less than 1% of their total vehicle sales.


At best, the large automakers are producing electric cars with limited range in limited volume. Some produce no zero emission cars at all.


Given that annual new vehicle production is approaching 100 million per year and the global fleet is approximately 2 billion cars, it is impossible for Tesla to build electric cars fast enough to address the carbon crisis. By the same token, it means the market is enormous. Our true competition is not the small trickle of non-Tesla electric cars being produced, but rather the enormous flood of gasoline cars pouring out of the world’s factories every day.


We believe that Tesla, other companies making electric cars, and the world would all benefit from a common, rapidly-evolving technology platform.


Technology leadership is not defined by patents, which history has repeatedly shown to be small protection indeed against a determined competitor, but rather by the ability of a company to attract and motivate the world’s most talented engineers. We believe that applying the open source philosophy to our patents will strengthen rather than diminish Tesla’s position in this regard.
