另一个版本，它是以美国法官查尔斯林奇的名字命名的，他在独立战争中实行私刑。还有，1780年宾夕法尼亚州引入了关于犯罪者应受惩罚和体罚的“林奇法”。
起初，法官查尔斯·林奇主持的一系列审判，并没有明显的种族潜台词。在一般情况下，查尔斯·林奇的行动集中在社会和政治不稳定的背景下维持公共秩序的，而事实上是简化战争的正义性。
法外处决是历史上社会常见的，私刑作为一种特殊的社会现象，平行于形式正义。
1860年出现的这类行为应被称为私刑，内战结束时，美国南方失利后北方实行了军事占领; 奴隶在战争中从完成自由的过程中宣称，他们要报复前业主。所谓的第一个秘密组织三K党成立，其成员广泛采用法外处决。1870年三K党被联邦政府铲除，但对黑人的恐惧一直没有停止过。代替奴隶制来到的是隔离法律（即N.黑人法律），以及不成文的礼仪，黑人必须遵守内格罗斯规定。针对普通法的罪行（谋杀，抢劫，强奸），黑人的违法行为会受到私刑和不成文的规则的处罚，黑人私刑数量的高峰发生在1892年（151名受害者）。在1882年到1968年间的美国，主要是在1882年到1920年之间，约有3,500名非洲裔美国人和1300名白人被私刑折磨致死。
在舆论的压力下，反对私刑的斗争由民主党总统富兰克林·D·罗斯福开始，1936年决定不采取更严格的法律打击私刑，害怕失去南方选民的支持，特别是G.杜鲁门。第二次世界大战后，私刑成为一种完全孤立的做法，通常与私人恐怖组织如三K党相关，每次都要进行调查。目前，林奇法院不复存在。在美国社会，对这种做法的道义支持已经消失。
