【摘要】医药企业投放医疗设备到医疗机构，同时销售耗材，有不少被认定为商业贿赂的执法案例。本文从商业贿赂的本质，法律规定以及行业现状等方面，对目前的执法实践提出不同看法，并建议在《反不正当竞争法》修订中予以完善。

【Abstracts】Pharmaceutical companies have put medical equipment into medical institutions and sold consumables, and there have been many law enforcement cases identified as commercial bribery. This article puts forward different views on the current law enforcement practice from the aspects of the nature of commercial bribery, legal provisions and industry status, and suggests that it be improved in the revision of the Anti-Unfair Competition Law.
