Group Play is part of NYGroupPlay.com and is a free service for all individuals aged 18 and older. Any registration by, use of or access to the Site by anyone under 18 is unauthorized, unlicensed and in violation of this Agreement.

Description of Service
Group Play facilitates playing state lottery games in groups, by providing tools that make that process easier and more entertaining. Group Play is authorized for use with Mega Millions from the New York Lottery as part of a Development Partnership with the New York Lottery.

Group Play is not part of the New York Lottery or any state lottery program and does not electronically connect to any state lottery system. Therefore, all activity that takes place on the Site is separate from the steps necessary to purchase a valid Mega Millions ticket. Use of Group Play is not and does not create a binding contract to purchase or provide lottery products, either among its members, or between its members and NYGroupPlay.com or its affiliates.

Limitation of Liability

In the event of a discrepancy between the information displayed on the Site concerning winning numbers and payouts and the information contained in the official and certified files maintained by the New York Lottery's Drawing Unit, those maintained by the Drawing Unit shall prevail.

Indemnification

Governing Jurisdiction

You hereby consent to the jurisdiction and venue of the Federal (and, where there is no Federal subject matter jurisdiction, State) courts located within the State of New York, which shall constitute the sole and exclusive forum for the resolution of any and all claims or disputes under these Terms of Use, and you hereby irrevocably waive any and all objections thereto, including grounds of forum non conveniens.

User Conduct
Group Play and the Site are available for your personal, non-commercial use only. You represent, warrant and agree that no materials of any kind submitted through your account or otherwise posted, transmitted or shared by you on or through the Site will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or propriety rights; or contain libelous, defamatory or otherwise unlawful material.

In addition, you agree not to use the Site to:

• register for more than one user account, register for a user account on behalf of an individual other than yourself, or register for a User account on behalf of any group or entity;

• upload, post, transmit, share, store or otherwise make available any content that we deem to be harmful, threatening, unlawful, defamatory, infringing, abusive, inflammatory, harassing, vulgar, obscene, fraudulent, invasive of privacy or publicity rights, hateful, or racially, ethnically or otherwise objectionable;
• upload, post, transmit, share, store or otherwise make available content that, in the sole judgment of Group Play, is objectionable or which restricts or inhibits any other person from using or enjoying the Site, or which may expose Group Play or its users to any harm or liability of any type.
• upload, post, transmit, share, store or otherwise make available content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
• intimidate or harass another;
• engage in any predatory or stalking conduct;
• use the Site in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site.

Inappropriate Content
Group Play encourages users to post user and team profile pictures and communicate within the Site as long as does not offend, harm or threaten users or make users uncomfortable. Therefore, you may not post or share content that:

• is obscene, pornographic or sexually explicit;
• depicts graphic or gratuitous violence;
• makes threats of any kind or that intimidates, harasses, or bullies anyone;
• is derogatory, demeaning, malicious, defamatory, abusive, offensive or hateful.

Group Play will use a content filtering system in an attempt to keep the Site appropriate for all users. However, there is no guarantee that all inappropriate content will be caught by the filter. Therefore, we encourage Group Play users to report inappropriate content and behavior by clicking on the red flag symbol for review by the Site's Customer Service. If Customer Service, in its sole discretion, determines that the content is inappropriate, it will be removed from the Site.

Termination
Group Play may terminate your membership, delete your profile and any content or information that you have posted on the Site and/or prohibit you from using or accessing the Site for any reason, or no reason, at any time in its sole discretion, with or without notice, including if it believes that you are under 18.

Group Play reserves the right to modify or discontinue the Site with or without notice to you.
