工程合同有关试车程序的约定（中英文对照）

工程试车Engineering Trial Run

试车程序Procedure of Trial Run

工程需要试车的，除专用合同条款另有约定外，试车内容应与承包人承包范围相一致，试车费用由承包人承担。工程试车应按如下程序进行：

Where the project needs the trial run or test, unless otherwise stated in particular condition, the contents of trial run shall be consistent with the same contracted by the contractor, the cost thereof will be born by the contractor, and the trial run procedure should be carried out as following:

（1）具备单机无负荷试车条件，承包人组织试车，并在试车前48小时书面通知监理人，通知中应载明试车内容、时间、地点。承包人准备试车记录，发包人根据承包人要求为试车提供必要条件。试车合格的，监理人在试车记录上签字。监理人在试车合格后不在试车记录上签字，自试车结束满24小时后视为监理人已经认可试车记录，承包人可继续施工或办理竣工验收手续。

The contractor shall, upon satisfaction of single machine unloaded commissioning, organize a trial run, and give the supervisor a 48 hours’ notice with trial contents, time and place thereof. The contractor prepares the trial record, the employer provide the necessary conditions for trial subject to the contractor’s requirement. Where the commissioning is qualified, the supervisor shall sign the record of the trial run, however provided that the supervisor refuse to sign the trial record upon the qualification of commissioning, the trial record may be on and from 24 hours subsequent to end of trial run, deemed as confirmed by the supervisor, and the contractor may continue to work or effect the formalities of completion acceptance.

监理人不能按时参加试车，应在试车前24小时以书面形式向承包人提出延期要求，但延期不能超过48小时，由此导致工期延误的，工期应予以顺延。监理人未能在前述期限内提出延期要求，又不参加试车的，视为认可试车记录。

Where the supervisor cannot participate in commissioning on time, should give 24 hours written notice to the contractor to postpone, however cannot exceed 48 hours of extension, if, resulting in delays of works, the working term will be extended correspondingly. Where the supervisor fails to provide requirement of postpone nor joining trial run, the trial record may be deemed as have been confirmed by the supervisor.

（2）具备无负荷联动试车条件，发包人组织试车，并在试车前48小时以书面形式通知承包人。通知中应载明试车内容、时间、地点和对承包人的要求，承包人按要求做好准备工作。试车合格，合同当事人在试车记录上签字。承包人无正当理由不参加试车的，视为认可试车记录。

The employer shall, upon satisfaction of single machine unloaded commissioning, organize a trial run, and give the contractor a 48 hours’ notice to the contractor with trial contents, time, place and the requirements to the contractor thereof. The contractor shall make the prepare subject to the requirement. Parties hereof will sign on the trial run record upon the qualification of trial. Where the contractor refuse to join in the trial without due ground, will be deemed as have confirmed the record.

试车中的责任Liabilities of Trial Run

因设计原因导致试车达不到验收要求，发包人应要求设计人修改设计，承包人按修改后的设计重新安装。发包人承担修改设计、拆除及重新安装的全部费用，工期相应顺延。因承包人原因导致试车达不到验收要求，承包人按监理人要求重新安装和试车，并承担重新安装和试车的费用，工期不予顺延。

Where the commissioning fails to satisfice the accept requirements due to design reason, the employer shall require designer to make modification of the design and the contractor will make re-installation subject to the amended design. The employer shall bear all the expenses for modification, design, dismantlement and re-installation thereof, and the time limit for the project shall be postponed accordingly. Where commissioning fails to meet the requirement of acceptance due to the contractor's reasons, the contractor shall as required by the supervisor make the re-installation and the trial, in addition to bear the cost of re-installation and trial run, and the construction period shall not be postponed.

因工程设备制造原因导致试车达不到验收要求的，由采购该工程设备的合同当事人负责重新购置或修理，承包人负责拆除和重新安装，由此增加的修理、重新购置、拆除及重新安装的费用及延误的工期由采购该工程设备的合同当事人承担。

Provided that the failure of trial run to the requirement of acceptance due to the manufacture of engineering equipment, the party which effecting the procurement of engineering equipment will be liable for re-procurement or repair, the contractor will be liable to make dismantlement and re-installation thereof, and the added costs with respect to the repair, re-procurement, dismantlement and re-installment in addition to the delayed time will be born by the party which effecting procurement thereof.

投料试车Commissioning Trial Run

如需进行投料试车的，发包人应在工程竣工验收后组织投料试车。发包人要求在工程竣工验收前进行或需要承包人配合时，应征得承包人同意，并在专用合同条款中约定有关事项。

Where it’s necessary to effect the commissioning trial run, the employer shall organize to do so subsequent to the completion acceptance. In case the employer require to do so prior to the acceptance or need the contractor’s cooperation, shall take the employer’s consent and stipulate the relevant matters in particular condition hereof.

投料试车合格的，费用由发包人承担；因承包人原因造成投料试车不合格的，承包人应按照发包人要求进行整改，由此产生的整改费用由承包人承担；非因承包人原因导致投料试车不合格的，如发包人要求承包人进行整改的，由此产生的费用由发包人承担。

If, the commissioning trial run is satisfaction, the cost thereof will be born by the employer; however, the trial run is fail to satisfaction due to the reason of the contractor which should subject to the employer’s requirement carry out the rectification thereof and the costs arising therefrom will be born by the contractor; the failure of satisfaction of the trial is not the contractor’s reason, if the employer require the contractor make rectification thereof, the cost arising therefrom will be born by the employer.

Trial Run   工程试车

If it is agreed to execute the trial run for special items like the cranes or the air conditioning, the scope of the trial run must be in strict compliance with the requirements under the technical attachment of the Contract.

双方约定需要对特派项目进行试车的，比如：行车、空调，试车内容必须严格按照本合同技术附件的要求进行。

If the Employer deems a trial run of the production equipment necessary, it shall conduct the same in accordance with the provisions of this Article.

如发包人认为确有必要对生产设备进行试车的，应按本款的约定进行试车。

When in the course of production equipment installation, a single machine is ready for trial run without any load, the Contractor shall organize a trial run, and shall notify the Employer’s Representative in writing of such trial run 48 hours in advance. The notice shall include the content, time and place of the trial run. The Contractor shall prepare the record of the trial run, and the Employer shall provide the necessary conditions for the trial run according to the Contractor’s requirements. If the trial run meets the standards, the Employer’s Representative shall sign on the record of the trial run.

生产设备安装工程具备单机无负荷试车条件，承包人组织试车，并在试车前48小时以书面形式通知发包人代表。通知包括试车内容、时间、地点。承包人准备试车记录，发包人根据承包人要求为试车提供必要条件。试车合格，发包人代表在试车记录上签字。

When in the course of production equipment any installation, the whole set of machines is ready for a trial run without load, the Employer shall organize a trial run and shall notify the Contractor in writing of such trial run 48 hours in advance. The notice shall include the content, time and place of the trial run, and the requirements to the Contractor. The Contractor shall make the preparations according to the requirements. If the trial run meets the standards, the two Parties shall sign on the record of the trial run.

生产设备安装工程具备无负荷联动试车条件，发包人组织试车，并在试车前48小时以书面形式通知承包人。通知包括试车内容、时间、地点和对承包人的要求，承包人按要求做好准备工作。试车合格，双方在试车记录上签字。

(1) If the trial run fails to meet the inspection requirements due to reason of the design, the Employer shall request the Designer to modify the design, and the Contractor shall re-install according to the modified design. The additional Expenses for design modification, demolition and re-installation shall be borne by the Employer, and the Project Period shall be postponed accordingly. However, if the design for the corresponding part is completed by the Contractor, the Contractor shall modify the design and re-install according to the modified design, and shall bear all the Expenses for the design modification, demolition and re-installation, where the Project Period shall not be extended.

由于设计原因试车达不到验收要求，发包人应要求设计单位修改设计，承包人按修改后的设计重新安装。发包人承担修改设计、拆除及重新安装的额外费用，工期相应顺延。但如相应部分的设计由承包人完成，则承包人应修改设计，并按修改后的设计重新安装，并承担修改设计、拆除及重新安装的全部费用，工期不予以顺延。

(2) If the quality of the machine causes the failure of trial run, the Party that purchased the machine shall be responsible to re-purchase or repair it, and the Contractor shall be responsible for the demolition and re-installation. If the machine is purchased by the Contractor, the Contractor shall bear the cost of repair or repurchase, demolition and re-installation, and the Project Period shall not be extended. If the machines is purchased by the Employer, the Employer shall bear the above-mentioned costs as Additional Contract Price and the Project Period will be postponed accordingly.

由于设备本身的质量原因试车达不到验收要求，由该设备采购一方负责重新购置或修理，承包人负责拆除和重新安装。设备由承包人采购的，由承包人承担修理或重新购置、拆除及重新安装的费用，工期不予顺延；设备由发包人采购的，发包人承担上述各项追加合同价款，工期相应顺延。

(3) If the failure of trial run is due to the Contractor’s construction, the Contractor shall re-install and conduct the trial run as request by the Employer’s Representative and bear all of the relevant Expenses for the reinstallation and the trial run, and the Project Period shall not be postponed..

由于承包人施工原因试车达不到验收要求，承包人按发包人代表要求重新安装和试车，并承担重新安装和试车的费用，工期不予顺延。

Only after the trial run without load turns eligible can the Contractor continue the execution of the Project or conduct the inspection for the completion of the Project.

无负荷试车合格后，承包人方可继续施工或进行竣工验收。

If the Employer needs the cooperation of the personnel to be assigned by the Contractor in conducting the trial run with load, the Contractor shall assign the relevant professional personnel to participate according to the instruction of the Employer. The Expenses of the trial run with load shall be borne by the Employer, and the labour costs of the Contractor may be reasonably compensated by the Employer.

发包人如在负荷试车时需要承包人派员配合, 承包人需根据其指令派有关专业人员参加, 负荷试车的费用由发包人承担，承包人的劳务费用可以由发包人适当补偿。

Completion of Design-Build – gives the criteria necessary for completion to be achieved, and for the Commissioning Certificate to be issued. In this respect the Commissioning Certificate is like the Taking Over Certificate found in the other books – but in this document it certifies that the DB is complete AND it also gives the commencement date for the Operation Service.

设计—建造的竣工—给出竣工达到的必要标准，发放试车证书。在此点上，试车证书同其它合同中的移交证书相同。—在DBO合同中试车证书证明设计—建造的竣工和运营服务的开始。

Commencement of Operation Service- this ties in with Clause 9.12 and the issue of the Commissioning Certificate.

运营服务的开始—本规定同9.12款有联系，发放试车证书。
