REGULATIONS ON THE PARTICIPATION OF FOREIGN ELITE ATHLETES IN MARATHON IN CHINA BY THE CHINA ATHLETICS ASSOCIATION

  第一章 总 则Chapter One  General Rules

　第一条 为了保证在中国境内举办的国际马拉松赛事的有序进行，规范外籍优秀运动员参加中国境内的国际马拉松赛事，特制定本规定。

Article 1. For the purpose of ensure the orderly hold of international marathons in China and regulating the participation of foreign elite ahtletes in China’s international marathons, hereby this regulations is made.

 

　　第二条 本规定依据国际田联相关要求及规定和《中国境内马拉松赛事管理办法》、《中国境内马拉松赛事组织管理实施细则》制定以下规定。

Article 2. The following provisions hereof are formulated in accordance with the relevant requirements and regulations of the IAAF, the Administration of Marathon Events in China and the Rules for the Implementation on Administration of Marathon Events in China.

 

 

　　第三条 中国田径协会(以下简称中国田协)是中国境内唯一合法的国际田联会员协会。根据国际田联的有关规定，外籍优秀运动员参加在中国境内举行的各种田径赛事，须经过中国田协的同意和批准。

Article 3. China Athletics Association (hereinafter referred to as the CAA) is the only legal IAAF member in China. In accordance to the relevant regulations of the IAAF, the participation of foreign elite athletes in various track and field competition held in China must be subject to prior consent and approval of China Athletics Association.

 

　　第四条 外籍优秀运动员是指户籍不在中国境内的高水平运动员。

Article 4. Foreign elite athletes refer to the high-level athletes whose registered permanent residence are not within China.

 

外籍优秀运动员定义为：在中国境内举行的马拉松正式比赛中取得马拉松或半程马拉松前10名；或男子全程成绩达到2:20:00、女子全程成绩达到2:35:00、男子半程成绩达到1:05:00、女子半程成绩达到1:15:00的外籍运动员。

Foreign elite athletes are defined as the top 10 marathoners or half-marathoners in official marathons held in China; or the foreign athletes who scored 2: 20: 00 for men’ marathon, 2: 35 for women’ marathon, 1: 05: 00 for men’s half-marathon and 1:15:00 for women’s half-marathon.

 

　　第五条 外籍优秀运动员参赛将纳入中国田协的统一管理，中国田协将对其参赛资格进行审核，并有权拒绝其参赛。

Article 5. Foreign elite athletes will be included in the unifies management of China Athletics Association which will review and examin ethlete’ s eligibility and reserve the right to reject them to participate in the competition.

        第二章 外籍优秀运动员参赛规定

Chaper Two Regulations for Participation of Foreign Elite Ethletes

 

　　第六条 外籍优秀运动员可通过被组委会特邀或个人经组委会报名系统报名两种方式参加中国田协年度竞赛计划内(含共同主办和批准等)的国际马拉松赛事。

Article 6. Foreign elite athletes can participate in international marathon competitions which comprised in the annual competition program of China Association of Athletics (including co-sponsorship and approval) through two ways, viz. special invitation by Organizing Committee or enrolment on the registration system of Organizing Committee.

 

　　第七条 每名外籍优秀运动员，无论是通过组委会特邀或个人报名，每年最多可参加2场中国境内的马拉松赛(参加半程马拉松不限制)。

中国田径协会将定期发布年度参赛达2次的外籍优秀运动员名单。

Article 7. Each foreign elite athlete, whether invitation by Organizing Committee or individual enrolment, can participate in up to 2 marathon races in China each year ( half marathon is not restricted ).

The name list of foreign elite ethletes who have participated in twice marathons will be issued by China Athletics Association.

 

　　第八条 外籍优秀运动员代表国内俱乐部或相关团体参加全国马拉松赛事的，该外籍优秀运动员需在中国连续居住满2年以上，并须得到其所在国田径协会的批准函和代表该俱乐部在中国田径协会注册备案的。

Article 8. Provided that a foreign elite athlete will participates in a national marathon by or on behalf of domestic club or respecting team, the foreign elite ethlete in question shall have resided in China for a continuous period of more than two years in addition to obtain the Approval Letter from his / her country’s Athletics Association and registration / filing with China Athletics Association on behalf of the club.

 

　　以国内单位员工或学生名义参赛的外籍优秀运动员，需提供中国政府签发的工作签证、学生签证和学籍证明。

The foreign elite ethlete who participate marathon in the name of employee or student in China shall provide the visa of work / student and the certificate of student status issued by China Government.

 

　　第九条 组委会特邀的外籍优秀运动员享有如下权益：

Article 9. Foreign elite athletes invited by Organizing Committee enjoy the following rights and interests:

 

 

　　1. 组委会为其提供邀请函，协助其办理来华签证；

Organizing Committee provides the invitation letter and assist the applicant to apply for the visa to China.

 

　　2. 组委会为其提供食宿，或有可能提供旅费或出场费；

Organizing Committee will provide the guest runner with board and lodging, if practicable, with travel expense and apperance fee;

 

　　3. 不用通过报名系统报名，不用缴纳报名费；

Not to entry through entrance system, nor make payment of entrance fee;

 

　　4. 享有组委会提供的特邀号码布、检录区和出发区。

Enjoy the number cloth of guest runner, record area and departure area provided by Organizing Committee.

 

　　第十条 组委会不得为非特别邀请的外籍运动员提供邀请函、出场费、旅费及食宿；不得为非特邀的外籍运动员提供专门号码布，不得让其站位在特邀外籍优秀运动员检录区和出发区。

Article 10. Organizing Committee shall not provide the foreign athletes who are not specially invited with invitation letters, appearance fees, travel expenses, board and lodging; nor provide special number cloth to non-invited foreign athlets, nor shall they be allowed to stand in the marshalling zone and start zone for invited foreign elite athletes.

 

 

　　第十一条 组委会特邀的外籍优秀运动员须参加赛前技术会议、新闻发布会、颁奖仪式、官方宴请等组委会指定活动。

Article 11. Foreign elite athletes specially invited by Organizing Committee shall attend pre-competition technical meetings, press conferences, award ceremonies, official banquets and other designated activities by Organizing Committee.

 

 

　　第十二条 外籍优秀运动员须在比赛中遵守竞赛规则、赛事规程和技术会议的相关规定。

Article 12. Foreign elite athletes must observe contest rules, regulations of the competition and the concerned stipulations of technical meeting.

 

　　第十三条 外籍优秀运动员在比赛时着装须符合国际田联和中国田径协会相关广告规定。

Article 13. The dress of foreign elite athletes shall conform to the advertising regulations by the IAAF and China Athletics Association.

 

　　第十四条 组委会须在比赛结束后一周内将符合总则成绩标准的外籍优秀运动员及比赛前20名外籍运动员的名单和成绩报送中国田协备案。

Article 14. Organizing Committee shall, within one week subsequent to end of competition, sumit to China Athletics Association for record with the name list and race results of the foreign elite athletes and the top 20 foreign athletes who are conformance with the result standard stipulated by this general regulation.

 

第三章 特邀外籍优秀运动员邀请管理

Chapter Three Administration of Guest Alite foreign Athletes

 

　　第十五条 凡列入中国田协年度竞赛计划(含共同主办和批准等)的马拉松赛事，如组委会需特邀外籍优秀运动员参赛，须由中国田协或其授权经纪公司邀请，或由中国田协授权具备以下条件的赛事组委会开展邀请工作：

Article 15. Any and all marathons which have been listed in the annual competition plan of the China Association of Athletics (including co-sponsorship and approval), where organizing committee desire to invite the participation of foreign elite ethlites, should be subject to the invitation of China Athletic Association or its authorized brokery agency, or the organizing committee with the authorization by China Athletic Association and with following qualificatins to carry out:

 

　　1、有专人负责马拉松外籍优秀运动员邀请工作；

Specially-assigned person being responsible for the invitation of foreign elite marathon athletes;

 

　　2、具备英文谈判、英文合同起草及联络沟通能力；

Wiht the abilities of negotiation in English, drafting contract in English and liaison and communication;

 

　　3、了解国际田联和中国田径协会相关规定，并严格遵守各项规定；

With acquaintance and acknowlegement of the relevant regulations of IAAF and China Athletics Association, and strictly observe the regulations;

 

　　4、与国际田联经纪人或无经纪人的外籍优秀运动员直接签署邀请合同；

Effect signature of the invitation contract directly with the IAAF agent or foreign elite athletes without broker;

 

　　5、了解马拉松运动员经纪行业规则和行业发展动向。

With acquaintance and acknowlegement of the rules of marathon broker profession and  development of the profession.

 

如组委会拟自行开展运动员邀请工作，须于申报赛事时同时提出申请，或至少于赛前四个月提出申请。

Provided that organizing committee intends to effect the invitation of athlets on its own, should be subject to file an application at the same time of declaration of competition, or file the application at least four months prior to competition.

 

第十六条 获得授权的组委会，可通过以下两种渠道邀请外籍优秀运动员参赛：

Article 16. The organizing committee which has acquired the authorization may, through below two channels to invite foreign elite ethletes to participate marathon:

 

　　1、直接通过国际田联注册经纪人邀请；

Invitation will be effected directly through the broker which register in IAAF.

 

　　2、直接邀请运动员本人(如运动员无经纪人)

Direct invitation to an athlete self (e.g., the athlete without an agent)

 

第十七条 获得授权的组委会，有义务核实运动员与经纪人的关系，或运动员是否有经纪人。组委会须直接与国际田联注册经纪人或运动员(运动员无经纪人)签署邀请协议。

Article 17. The authorized organizing committee is obliged to check and verify the relationship between the athlete and broker, or whether the athlete has an broker. Organizing committee should conclude an invitation agreement directly with the broker registered in IAAF or athlete himself who without broker.

 

　　第十八条 邀请外籍优秀运动员所需费用由各赛事组委会自行负担。

Article 18. The costs of inviting foreign elite athletes shall be on the account of the organizing committee.

 

第十九条 赛事组委会每场比赛最多可邀请每个国家的男、女各3名外籍优秀运动员参赛，每场比赛还可邀请男女各3名领跑运动员。该场赛事的往届男、女前3名运动员不包括在内。

Article 19. Organizing committee of the competition may invite at most three male and three female foreign elite athletes from one country to participate each competition in addition to three male and three female leading runners, however, the top three male and three female foreign elite athletes of former competition are exclusive thereof.

 

　　第二十条 同一场马拉松赛中有半程马拉松、10公里等项目，只允许半程马拉松项目邀请外籍优秀运动员参加。

Articles 20. Foreign elite athletes are only allowed to participate in marathon where in the same competetion have marathon, half marathon and other events.

 

　　第二十一条 赛事组委会须在赛前10天将特邀外籍优秀运动员名单报送至中国田协审核，审核合格后方可接受特邀外籍优秀运动员参赛。

　　报送信息应至少包括：运动员姓名、性别、国籍、护照号码、所报项目、最好成绩、经纪人姓名、代表单位等相应信息。　　

Article 21. Organizing committee should, on 10 days prior to competetion, submit the list of the invisted foreign elite athletes to China Athletic Association for examination and approval before acceptance of participation of foreign ethletes.

The information should include, inter alia, name, gender, nationality, passport number, event, best result, broker name, representative unit, etc.

 

        第四章 处 罚Chapter Four Penalty

　　第二十二条 各地方组委会在外籍优秀运动员参赛及开展外籍优秀运动员邀请活动时，如未遵守以上要求，中国田径协会将视情节严重程度，对违规的地方组委会做相应处罚，包括但不限于取消外籍优秀运动员邀请授权、降低该赛事评级或不予评级、取消共同主办该赛事、停止对该赛事审批1-3年等。

Article 22. Provided that the local organizing committee fails to comply with the above requirements on participation of foreign elite athletes and invitation thereof, China athletics Association will impose penalty on the local organzing committee for violating the rules depending on the seriousness of the circumstances, include, inter alia, cancelling the invitation authorization of foreign elite athletes, downgrading or refuse grade the event, canceling co-hosting of the event, and suspending approval of the event for 1-3 years.

 

　　第二十三条 未按照以上各项规定邀请外籍优秀运动员参加马拉松赛事的经纪公司、经纪人和俱乐部，将按以下办法进行处罚：

Article 23. Brokerage company, brokers and clubs that fail to invite foreign elite athletes to participate in marathons in accordance with the above provisions shall be imposed a penalty as per the following measures:

 

　　一、如发现以弄虚作假和欺骗隐瞒方式为外籍优秀运动员报名参加全国马拉松赛事的俱乐部，将停止2年该俱乐部在中国田协的注册资格。

1. Provided that the club that entering for participation of national marathon for foreign athletes by means of fraud and deception, the registration thereof in China Athletics Association will be suspended for two years.

 

　　二、经纪公司和经纪人一旦出现违规行为，如：邀请外籍优秀运动员的国籍和运动成绩与实际情况不符，未安排及督促外籍优秀运动员按时出境，随意克扣外籍优秀运动员赛事奖金和出场费等情况的，将取消该经纪公司、经纪人与中国境内马拉松赛合作的资格。对国际田联注册经纪人的违规行为，将通报国际田联。

2. Where violations of a brokerage company and broker occur, such as, the nationality and competetion score are not conform to the actual situation, fail arrange or urge the foreign elite athletes to exit China and arbitrary withholding of prize money and appearance fee for foreign elite athletes, the brokerage company and broker will be disqualified from cooperation with the marathon in China. The violations of the broker which register to IAAF will be informed to IAAF.

 

　　第二十四条 违反国际田联竞赛规则、中国田协相关规定和赛事竞赛规程的外籍优秀运动员将被处以停止参加中国境内比赛1-3年的处罚，同时中国田协将通报外籍优秀运动员所在国田径协会。　　

Article 24. Foreign elite athletes who violate the rules of the IAAF and China Athletic Association will be punished with a penalty of 1 to 3 years' suspension from participation in China, moreover, China Athletics Association will inform the athletics association of the countries where foreign outstanding athletes are located.

 

        第五章 附则Chapter Five  Supplementary Provisions

　　第二十五条 此规定从下发之日起执行，解释权归中国田径协会所有。

This regulation shall be implemented from the date of issue and the authority of interpretation shall be vested in China Athletics Association.
