OUTSOURCED CROSS TRAINING AGREEMENT

The two parties A and B reached an agreement on the following items:

甲乙双方就以下内容达成协议:

Obligation of Party A: 甲方责任：

1)        Party A will arrange for Party B to      undergo a cross training in     .      

甲方将安排乙方到     的培训。

2)    During the above-mentioned duration, party A will arrange for party B to be given on-the-job training for the benefit of improving B’s working capabilities, knowledge, experience and skills.

上述时间内甲方安排乙方接受在职培训以期提高乙方的工作能力、知识经验及技能。

3)    Party A will arrange for party B to be provided the following during the training period:

   培训期内，甲方将安排提供乙方以下各项内容：

a)    Party B ‘s wages and other benefits remain unchanged during the training.

     乙方培训期间在甲方的工资及其他福利待遇不变。

b)    Return tickets expenses and accommodations. 来往机票费用及住宿安排。

c)    Meals as provided for at training period. 培训期内的膳食。

d)    Party A will responsible for party B’s injury on duty or emergency cases medical treatment and hospitalization expenses related to work during the training period.

乙方在培训期间的工作时间发生的工伤及与工作相关的急症住院医疗费用由甲方承担。

4)    Party A reserves the right and authority to terminate the training under the following circumstances, and party B need to compensate all the concerned occurred expenses to party A:

   在下列情形下，甲方有权终止培训，并且乙方应当赔偿已发生的相关费用：

a)    Party B is unable to meet the required work standards during the training.

 乙方在培训期间不能达到培训标准

b)    Party B is unable to continue with the training program due to sickness or injuries.

乙方因疾病或受伤不能继续培训

c)    Party B violates employment and labor rules or other regulations as set.

     乙方违反约定的劳动条例或其他规章制度

d)    Party B commits any unlawful acts in the place of training.

     乙方在培训期间实施了任何违反法律的行为

5)    Party A will reserves the right and authority to terminate the training through early completion of training or some special cases not within party A’s capability to control. 

由于甲方无法控制的原因或提前达到培训目的而提前终止培训的 ，甲方有权 终止培训。

Obligation of Party B:  乙方责任：

1.    Party B will abide to all the rules and regulations as set by party A pertaining to the training program and its related conditions.

   乙方应遵守所有甲方制定的关于培训及相关情况下的规章制度。

2.    Upon completion of training, party B must continue the employment tenure with party A from      to       . Should party B willfully terminate the employment tenure with party A, or should party B commit any act that warrants disciplinary measures which may result in a termination of employment contract by party A during the employment period after the training, party B will need to reimburse party A the full expenses RMB ____ Yuan incurred for the training.

 After completion of the training, the reimbursement of the training fee will be  deducted 1/24 with party B’s completion of every one month employment  contract with party A. The remainder of the total training costs should be the reimbursement paid by party B.

 培训结束后，乙方必须履行完     至     止的劳动合同，合同截止之前乙方提出解除合同，或由于乙方违纪行为导致的甲方提前解除合同，乙方需向甲方赔偿全部培训费用___元                 人民币。培训结束后，乙方每履行完劳动合同一个月，赔偿金额即从总培                 训费用中递减二十四分之一，剩余部分作为乙方支付培训费用的金额。

3.    Party B will furthermore be liable to all legal fees incurred by party A related to the willful breach of contract by party B.                                                                                

乙方应支付所有由于乙方违约而导致甲方承担的相关法律费用。

4.    Party B will responsible for party B’s non-work related injuries and other medical treatment and hospitalization expenses during the training period.                                    

  在培训期间乙方对自己非工伤和其他医疗、住院的费用负责。

5. This contract is an additional training agreement for the employment contract, all the other items of the employment contract remain unchanged, this agreement will be valid from the staring date of the training. 

本协议作为劳动合同专项培训的补充协议，劳动合同的其他条款不变，本协议自培训开始日生效。

6. This contract and all its condition have been read, understood and agreed to by all the two parties (party A and party B). 

本协议及相关条款已经被甲乙双方阅读及理解并同意。
