这是同事分享的一个案例。
他的客户在2017年收到了曼省投资移民的省提名信，并交纳了10万加元的保证金。之后，递交了联邦申请。
最近，客户收到了联邦发来的信，说他的雅思成绩太低，要求客户在90天内提交回复。
分析：
这个属于执法程序公平方面的问题。一般情况下，如果申请者能在规定时间内递交明显改善的雅思成绩，省提名获得者将会获得联邦批准。
对于经济类移民来说，考察的核心是其"Ability
to become economically establish"
下面是IRPA关于语言能力不够而拒发签证的一些依据：
IRCC can deny PNP Nominees
R87(3) (4). & OP 7(b)
immigration officer may
issue a negative substituted evaluation and refuse an application
where the officer is not satisfied that a provincial nomination
certificate is an appropriate indicator of whether an applicant
will be able to successfully establish themselves economically in
Canada.

Noreen v. Canada (Minister of Citizenship and
Immigration), 2013 FC

Applicant
in fact demonstrated improved languages scores
however it was still
denied statement:
“Although [Ms. Noreen] has obtained a higher overall score on her
more recent IELTS test, the English language proficiency it shows
her to have still appears to be below the level
of fluency which would be required in order
for her to become qualified as a teacher in Saskatchewan … [Ms.
Noreen] appears to acknowledge that she could not establish until
some undefined point in the future after her English has improved.
[Ms. Noreen] states that her current level of English would not be
a problem in ‘basic odd jobs’ but she does not indicate having a
job offer of any kind.”

If the officer is not satisfied that the individual intends to
enter the labour market, they should consider refusing the
application. Part-time or casual work that would not generate
enough income to fully support the
applicant may not meet this
requirement
