many problems can only be solved with the rule of law. if law is
lacking, affairs can become complicated. however, introducing new
laws into the legal system looks like a two-edged sword. if the
government sees the necessity of establishing a law in a certain
field, the law that comes into being is more often than not flawed.
it seems that the formulators deliberately create a law with a full
range of loopholes, which can turn key issues into murky dilemmas
and quandaries. just take a look at the criminal law and the law of
criminal procedures for example. the two laws have been amended
many times since they came into being in the late 1970s. every time
it was amended, some loopholes would still be there. and many
people complained and judged that the amendments were not good
enough. the latest amendments in this march 2012 aren't exceptions.
experts still complain about the flaws and defects and
imperfections in the two laws. the same description can apply to
other laws.
it seems that some legal experts want to establish a perfect legal
system with laws covering all fields of social and economic life.
when something bad happens, the first thing they want to know is
whether there is a law that governs affairs in this field. if there
is none, they want to make one. but what should happens is that the
law system should be reformed first before anyone looks forward to
a complete system of laws and regulations. more often than not,
judges cannot make independent decisions. more often than not,
interferences come in various shapes and forms and through all
kinds of channels.
nowadays many people just don't trust laws. this point can be
demonstrated through a long essay and there are many convincing
evidences to support this point. they seek solutions through
violence and other activities. they never go to law because they
know law will not help them. moreover, they see how bad guys go
scot free and how law does not go after them. what lessons do they
draw from what they experience?
the way law is practiced and executed makes it ineffective to
introduce more laws into existence. on the other hand, more laws
make agencies more powerful. when they want a law, they make it. if
they want loopholes and back doors, they create them. laws become
tools for them to make profits and help themselves benefit
themselves.
this is a dilemma about law. what is needed now? more laws? the
reform of the law system? other reforms that are preconditions for
reforming the law system?
