Defendant Is Facing 'Worst-Case' Charges

The charges lodged by New York prosecutors against Dominique Strauss-Kahn on Monday are extremely serious, said criminal-defense lawyers, and could lead to significant prison time for the International Monetary Fund head if he is found guilty of even one of the main charges.

"Prosecutors have charged this as heavily as they possibly could have," said Daniel J. Horwitz, a criminal-defense lawyer in New York and a former prosecutor in New York. "This really is the worst-case scenario" for the defendant.

On Monday, the New York County District Attorney's office filed seven charges against Mr. Strauss-Kahn arising out of an alleged incident on Saturday involving a maid at the Sofitel Hotel in Midtown Manhattan. The charges include two counts of first degree criminal sexual act. That charge is known as a "class B violent felony" in New York, and carries a mandatory prison sentence of up to 25 years.

Mr. Strauss-Kahn's lawyer, Benjamin Brafman, didn't return a call seeking comment on Monday. He has said that Mr. Strauss-Kahn will plead not guilty.

On Monday, New York City Criminal Court Judge Melissa Jackson denied Mr. Strauss-Kahn's request for bail and remanded him back into custody, where he will stay until at least the end of the week. Monday afternoon, Mr. Strauss-Kahn was moved to the prison on New York City's Rikers Island.

"The only thing I am here to consider is…is your client a real risk of flight," said Judge Jackson during the hearing. "When I hear that your client was at JFK airport, about to board a flight, that raises some concerns."

Mr. Brafman said at a news conference Monday that he was considering appealing Judge Jackson's ruling on bail.

Prosecutors now have several days in which to convene a grand jury and bring a formal indictment against Mr. Strauss-Kahn.

If a grand jury indicts him, the case will move to a different judge in the New York system, and Mr. Strauss-Kahn and his lawyers will get another chance to argue that he should be let out on bail. Lawyers on Monday called it unusual for a New York judge to deny bail. "But it isn't surprising given the circumstances," said Paul Shechtman, a criminal-defense lawyer in New York. "He is a person of means and prominence, and if you lose him back to France, you might never get him back," he added, referring to France's general reluctance to extradite its citizens. "That's a recipe for holding someone."

Home confinement, often made possible by ankle bracelets or other devices that track the wearer's comings and goings, is used less frequently in the New York state system than in the federal system.

Still, lawyers said they could imagine a situation in which Mr. Strauss-Kahn is allowed to stay in, say, a Manhattan apartment under strict surveillance—possibly paid for by Mr. Strauss-Kahn. "I think they'll look for a way to do house arrest," said Mr. Shechtman.

From there, a trial date will be set. Under New York law, most criminal trials have to happen within six months of the arrest date, but various motions often "stop the clock," and delay the start.

So far, Mr. Strauss-Kahn has been treated with a rather firm hand, said lawyers. But they added that the treatment wasn't unusual, given the nature of the charges. "The DA takes sex crimes very seriously," said Mr. Horwitz, who referred to the rather stiff sentences for the most serious charges lodged against Mr. Strauss-Kahn.

"They all have mandatory time," he said, adding that he would likely serve in a medium- or maximum-security facility if convicted. "This is the state system. There's no 'Club Fed' in the state system."
