自由、法治、经济杠杆：社会组织管理框架和思路

——来自法国非营利社团组织法的启示

【摘  要】以市场经济和民主政治为导向的中国社会转型呼唤着公民社会的培育和社会组织的发展。实践中管得过死制约社会组织的发展、过于放任又威胁稳定的两难困境要求我国全面推进社会组织管理体制变革。本文通过对法国非营利社团组织法的介绍和分析，认为自由、法治、经济杠杆是法国社会组织管理的基本框架和显著特征；结合我国培育和发展社会组织的客观需要，提出了我国社会组织管理体制改革的相关建议。

Freedom , rule by law , economic lever:the frame and stratary of social organization management: some ehlingtment from NPO law in France

【 abstract】 It is necessary to cultivate the citizen society and develop the socieal organization under the type transition of the market economic and the development of democratic politics. In practiceof social organization managemnet, there are the difficult choices betwween the dead restriction and unccontroled to threaten the social stabilization. Therefore the reformantion of management system should be carred out. This paper introduces the France association organization law and analysis their fertures, then concludes that freedom, rule by law and economic lever are notable feature and the basic frame of French social organization management. Combination the objective needs to cultivate and develop social organization in our country , this paper promotes four suggestions on Chinese social organization management system reform.
