<p><span STYLE="COLOR: #000000"><span STYLE="FONT-SIZE: 10pt; FONT-FAMILY: 宋体">上述情形的裁员只适合需要裁减人员二十人以上，或者裁减不足二十人但占企业职工总数百分之十以上的情况。用人单位必须与工会或者全体职工说明情况，听取工会或者职工的意见后，裁减人员方案经向劳动行政部门报告</SPAN><span STYLE="FONT-SIZE: 10pt; FONT-FAMILY: 宋体">。</SPAN></SPAN></P>
<p><span STYLE="COLOR: #000000"><span STYLE="FONT-SIZE: 10pt; FONT-FAMILY: 宋体">虽然扩大了的裁员基础提高了雇主的地位，但是法律中的一些不明之处还是问题所在，特别是如果当地劳动行政部门不同意的裁员基础合法性。如何决定什么时候发生了客观环境的变化，或者什么才是“重大困难”都不明确。</SPAN><span STYLE="FONT-SIZE: 10pt; FONT-FAMILY: 宋体">此外，新法规定：当裁减人员时，应当优先留用下列人员：</SPAN></SPAN></P>

<p><span STYLE="FONT-SIZE: 10pt; FONT-FAMILY: 宋体"><span STYLE="COLOR: #000000"><font SIZE="2">新法预见了劳动者、工会和用人单位之间的三方关系。新法指出在关系到劳动关系重要特征的问题时，比如薪资，福利、假期和劳动安全等，三方应相互协商。但是，新法没有指出在遇到无法解决问题的时候，谁有最终决定权。权利还是掌握在用人单位手中。如果用人单位的行为损害了劳动者的利益，那么工会可以寻求当地劳动仲裁部门的帮助。</FONT></SPAN></SPAN></P>

            <title>新的劳动合同法下企业的应对措施-From 黎明</title>

            <description><![CDATA[<p><span STYLE="FONT-SIZE: 10pt"><span STYLE="FONT-SIZE: 10pt">新的法律声来到我们身边，企业人力资源部是否已经做好准备。提前做好准备，总比来个措手不及比较的好，尤其是企业的人力资源管理工作，必须具有前瞻性，所以在新的法律实施前，人力资源部应从企业的角度做出分析，做好前期的准备工作。<br />

第一，对公司目前的人力资源做详细的分析。包括人员的基本信息（性别、年龄、学历、专业等）、技术水平、薪酬福利待遇、劳动用工的形式及合同签订的时间，从这些基本信息中掌握目前公司的人力资本及成本，然后确定合同签订的期限，这样有利益企业灵活的应用人力资源，让企业保持新的活力。如前段时间民企标杆公司华为要求旗下工作满8年的员工“主动辞职”再“竞聘上岗”，以至近万名元老工龄归零，当然不是所有的企业都有华为的经济势力，给员工合法的经济补偿金，可是企业要有竞争力才能在激烈的市场中生存下去，所以企业必须把一些吃大锅饭的员工请出公司，这样对公司目前的人力资源分析是必须的。但是我在此要强调的是我们企业也不要&nbsp;“没有原则”的对公司内部员工进行裁减，别因裁员曝光造成对企业形象的伤害。<br />

<br />
第二、提高人力资源部门人员的业务水平，把握招聘质量，避免招人不满意再解雇的情况出现。《新的劳动合同法》第四十条第二项及第四十六条第三项规定：用人单位对不能胜任工作的员工解除合同须要支付经济补偿金，所以在日常的招聘工作中，应该严格的筛选企业所需求人员，尽量减少由于招聘的疏忽使企业承当更大的人力成本。尤其是劳动密集型的企业，员工的流失比较的大，不要为填补一些急于需求岗位的替补人员而招聘不合格员工。因此要求负责招聘的人员必须熟练的掌握招聘岗位的操作流程、工作职责及很强的专业知识，能通过面试初步的了解应聘人员的职业操守。<br />

第三、规范各岗位的职位说明书，根据职位说明书来审核目前的人员编制。职位说明书不仅对日常人力资源管理中的人力资源规划、人员招聘与配置、培训与开发、绩效考核、薪酬管理、职业生涯管理&nbsp;等方面具有指导性，而且能让员工明确自己的职责，尤其是在员工不能胜任工作时，企业能有效地提出解除员工的证据，即《劳动合同法》第二十条规定：在试用期中，除劳动者有本法第三十九条和第四十条第一项、第二项规定的情形外，用人单位不得解除劳动合同。用人单位在试用期解除劳动合同的，应当向劳动者说明理由。有明确的职责后，企业取证难的问题也减少一些，让企业减少些不必要的麻烦，毕竟新的劳动合同法是倾向劳动者的一方。<br />

第四，加强公司员工正确认识新的劳动合同法,把企业的利益与个人的利益紧密的结合在一起。法律是保护劳动者的，但是企业经济效益得不到保障的时候，员工的利益也会得不到保护。所以在日常工作中，企业损害个人利益是很小并且是合理的时候员工就不能计较，员工更不能利用一些法律的空挡来找企业的麻烦。如：上班的时间不认真工作，而下班的时候却在公司内加班，还向企业要加班费。企业现在存在这样的人员，上班时间在做私人的事情，下班以后忙者加班，这部分人企业应重点的关注，适当的时候就把这部分人请出公司，毕竟现在支付的补偿金，比他们给企业带来的经济损失要少得多。另外就是部门经理在日常的管理中应该多注意员工的违纪及重大过错的记录，让企业辞退员工时能有充分的证据，让这些不为企业做事实的员工尽快离开本企业。<br />

<br />
第五、确定公司那些岗位需采用劳务派遣的方式。劳务派遣比较适合劳动密集型却流动性比较大的企业，尤其是女性占公司人员比例比较大的企业，应重点考虑。如酒店业，女员工的比例占到80%，每年招聘近来的员工的年龄都差不多，结婚及生小孩的年龄又相近。如果员工请假人数比较的多，招聘一批补上，老员工回来后又怎么处理，此时又不能解除合同，员工回来后解除合同，企业的成本就比较大，不仅为员工缴纳请假期间的保险而且需支付经济补偿金。因此选择劳务派遣比较的合适，针对劳务派遣不成熟的地区，企业与员工什么时候解除合同比较的好，企业应该认真的思考，并提出做出相应的计划工作。<br />

第六，分析目前企业各岗位及人员的信息，并确定劳动合同的签订的期限，在确定合同期限的时候应考虑几个问题：经济补偿金、竞争限制、培训违约金。而对一些重要的岗位的合同可以签订无固定期限劳动合同，同时企业为留住员工可以利用一些民事诉讼来与员工约定，如；为员工提供贷款，在公司服务几年公司将不在需要员工还款等。<br />

新的《劳动合同法》下，企业的人力资源成本将大幅度的增加，可能对于高科技的企业没有任何的影响，但是对于劳动密集型的企业将直接影响企业的发展。而人力资源部将尽力的去完成人力资源的基础工作，让企业减少成本，维持企业的发展。</SPAN></SPAN></P>]]></description>

昨天看到Sina上报道雅雯美女主持放弃了生活栏目的主持人，离开了她生活和战斗多年的舞台，去马兰担任总经理．起初有些不理解，因为央视又少了一个来自甘肃的主持人（裴新华张莉
水均益
朱军李修萍都是来自甘肃的优秀主持人），后来仔细考虑没有去别的公司而是去了马兰，我似乎理解了，因为拉面代表着甘肃的文化，而她来自离兰州最近的城市－－白银．</P>

刘雅雯小的时候在甘肃省白银市银光公司子弟学校，度过了自己的学生时代。听我在银光中学的姐姐哥哥说，小的时候，她可是学校的活跃分子，唱歌、跳舞、乐器（大提琴、弹过电贝斯、打过架子鼓）都很不错，追的男生很多。后来凭借着艺术特长，走进军营。复员后成为甘肃省白银市电视台的一名专业主持人，当时也在看她的节目，那时的她在主持上似乎并不是特别突出，三年后离开了白银，考入了梦寐以求的北京广播学院播音系。后来我来北京后，在《音乐电视歌迷行》节目录制中，突然觉得主持人特别的面熟，后来在介绍完她的姓名后，终于知道她来到了央视作导演兼主持人，于是在央视的里又多了一位甘肃人的身影。那时还没有多少人认识她，当《同一首歌》在全国唱响的时候，雅雯成为导演队伍中的一员。《生活》女主持人空缺时，雅雯从几十名竞争者中脱颖而出，成为《生活》栏目的一个新成员。<br />

            <title>What Recruitment is NOT（From  Mulligan, Frank）</title>

Mulligan is the CEO of Talent Software, a developer of recruitment
software, generally known as Applicant Tracking Systems(ATS), for a
broad range of industries in China.</FONT></P>

<div CLASS="sfsBlogContent"><font STYLE="FONT-FAMILY: Verdana">Recruitment in China is trending downward,
admittedly at a very slow rate, but it is still the number one
issue for HR departments.<br />
<br />
We all have our own understanding of what hiring is but it might be
instructive to look at what hiring is not.<br />
<br />
A. Firstly, hiring is <i>not the responsibility</I> of the HR
department. This is a line manager’s problem, and only they can
truly assess candidate fit with the job and the company. HR is
basically the government. It is there as the standard bearer for
candidate quality, and to ensure compliance with hiring policies.
HR can add value in terms of understanding the psychology and
motivation of both candidates and line managers so that a better
outcome is ensured. The final decision lies with the line
manager.<br />
<br />
B. Hiring is <i>not even a good fit with H</I>R itself in many
ways. Hiring is outwardly focused and subjective, which is exactly
the opposite of most HR functions like payroll, org charts,
succession planning etc. Hiring is more akin to marketing or
branding and it cannot be fulfilled with a box-filling or
bureaucratic approach. At the same time, hiring is not just about
ill-defined issues, like quality and engagement. Hiring can
and</FONT> <a HREF="http://www.hr.com/SITEFORUM?i=1116423256281&amp;s=&amp;t=/Default/openExternalURL&amp;url=aHR0cDovL2VuZ2xpc2gudGFsZW50LXNvZnR3YXJlLmNvbS8/cD0xMzk=" TARGET="_blank"><font STYLE="FONT-FAMILY: Verdana">should be
measured</FONT></A><font STYLE="FONT-FAMILY: Verdana">.<br />
<br />
C. Hiring is <i>not about waiting.</I> It is an intense function
that requires constant vigilance. Take your eye off the ball for
more than a few days and you will lose momentum. Change companies
on a regular basis and you will never be a good Recruiter.<br />
<br />
D. It’s a</FONT> <a HREF="http://www.hr.com/SITEFORUM?i=1116423256281&amp;s=&amp;t=/Default/openExternalURL&amp;url=aHR0cDovL2VuZ2xpc2gudGFsZW50LXNvZnR3YXJlLmNvbS8/cD01NDg=" TARGET="_blank"><font STYLE="FONT-FAMILY: Verdana">candidate's
market in China</FONT></A> <font STYLE="FONT-FAMILY: Verdana">right
now so hiring cannot be about finding candidates at the <i>lowest
possible overhead cost</I>. In this market you can be hiring
efficient, and save your pennies, but only at the cost of hiring
effectiveness. You can’t have both efficiency and effectiveness.
Telling your GM how you have saved RMBXXXXX on headhunter fees and
recruiter salaries will only fly if your hiring requisitions are
being filled on-time, in time.<br />
<br />
E. It’s not even about</FONT> <a HREF="http://www.hr.com/SITEFORUM?i=1116423256281&amp;s=&amp;t=/Default/openExternalURL&amp;url=aHR0cDovL2VuZ2xpc2gudGFsZW50LXNvZnR3YXJlLmNvbS8/cD02Nzg=" TARGET="_blank"><font STYLE="FONT-FAMILY: Verdana">staff
salaries</FONT></A><font STYLE="FONT-FAMILY: Verdana">. Hiring
people does not become that much easier when you increase the
salary. It is true that in the short-term you get ‘bums on seats’,
but the kind of people you get are the ones that will resign in a
very short time, and then you are back to square one. Seeking
people with the right fit ie. those with 80% of what you want, will
take longer but the net benefits are greater. The 20% that they
don’t have will allow you to offer them coaching and training, and
this will keep them engaged for longer period of time.<br />
<br />
F. Hiring is <i>not a gate keeping exercise</I>. It needs to be
inclusive, not exclusive. Candidate fit is not about filling your
office with people who all fit your culture exactly. Monolithic
cultures tend to die because there are problems out there in the
environment that they are not capable of seeing. Diversity is not
just a useful politically correct (PC) concept. It’s a survival
mechanism.<br />
<br />
G. <i>Hiring is not solvable</I> using Zhaopin.com, 51job.com or
Chinahr.com. These sites are an excellent start, and worth the
money, but they are just the minimum cost of entry. They offer you
a huge database of professionals to choose from, but this database
has been worked to death already, by your competitors.<br />
<br />
H. The hiring process itself is not an opportunity to tell
potential new staff how fantastic your company truly is. Your
company is fantastic, of course, but so is everyone else’s. On the
internet they say that no one knows you are a dog, and in China no
one knows you are the
World’s-Premier-Manufacturer-Of-Novelty-Items. No candidate cares
to hear this spiel because it means you are speaking to yourself,
and not to their needs.<br />
<br />
I. Hiring is not a jigsaw that the candidate has to figure out by
himself. It needs clear Job Descriptions with a linkage to KPIs
that will be assessed on a half yearly basis. The new</FONT>

Smith的电影，很多人和我一样非常喜欢这个黑人，我算是他的超级Fans了。不过这部电影肯定算不上他最优秀的电影，节奏非常的琐碎，主题不明确，包含了励志、爱情、悲剧场景也不是非常好。</P>
<p>但这部电影依然有不错的票房记录．我想很多人也是Will
Smith的忠实Fans吧，我对这部电影打分65分，刚刚及格。但是我觉得片子里还是有很多值得去领悟的情节。</P>

杰森·贝特曼在片中饰演了雷·安布里，一位为了汉考克可谓呕心沥血的公关经理，当他给客户策划案遭到客户的讥讽后，成功的导演了一场重塑汉考克群众形象的经典公关案例．－－－－－“当汉考克救了雷一命后，雷决心要帮助汉考克学会如何举止合体，并洗刷汉考克的形象污点，他希望能通过这个来回报汉考克的救命之恩。但是，对于雷来说，这可不仅仅是简单的公关形象管理工作，他是真心地想教会汉考克如何当一个好的超级英雄。”一系列的事情让汉考克开始思考自己的能力和责任，而且在后面的救人过程中让人们重新认识了这个超人，剧情发展到这是，让人出人意料的是，雷的妻子玛丽也是一位超人，细心的观众会有所察觉，导演在影片的开始已经有所铺垫，她对于汉考克的行为一直非常不屑，甚至试图阻止丈夫帮助汉考克。汉考克在与玛丽的交往中发现自己的超能力会减弱，而此时，一伙曾被汉考克送进监狱的匪徒也开始了阴险的报复行动，结果是汉考克与玛丽在一次分开。<br />

关于爱情部分，导演在玛丽和汉考克两人之间微妙的关系中把爱情的真谛通过这种特殊的手法诠释的淋漓尽致。两人一旦靠近就会失去力量，甚至失去生命。玛丽也说过，以前有很多和他们一样的人，都是成双成对的，但是最后都死了...原因是“爱情”——他们离的太近了。<br />

<b>　　</B>生活中何尝又不是这样，距离太近就会有摩擦；就会有矛盾。大家都不是圣人，就算是强大到如汉考克、玛丽这种神样的存在，也劫数难逃。好在最危险那一刻汉考克拼命的离开了玛丽，才保住了各自的性命。<br />

<b>　　</B>这是导演给生活中出现感情危机的人们指点了一条迷津，空间的距离也许能够挽回心的距离吧。<br /></P>

            <title>祥云圣火火炬在兰州传递</title>

            <description><![CDATA[<p>白银是我的家，兰州是离我家最近的城市，是甘肃的省会．由于在北京工作，没有看到圣火在家乡的传递，好遗憾。</P>

祥云火炬从中山桥桥南广场出发后，围绕闻名遐迩的南北滨河路黄河风情线进行传递活动，途径兰州市城关、七里河、安宁三个区，经过黄河母亲雕塑、生命之源、龙源公园等景点，中途在安宁庭院作短暂休息，祥云火炬最后抵达极具特色的水车博览园进行结束仪式。</P>

<p>传递路线基本上都经过了兰州标志性的建筑，展示了“黄河明珠”的城市区域优势，以及“丝路重镇”的深厚文化底蕴。</P>

<p><span STYLE="FONT-SIZE: 10pt; FONT-FAMILY: 宋体">卢凡</SPAN><span STYLE="FONT-SIZE: 10pt">—</SPAN><span STYLE="FONT-SIZE: 10pt; FONT-FAMILY: 宋体">是一名之前在</SPAN><span STYLE="FONT-SIZE: 10pt">FedEX</SPAN><span STYLE="FONT-SIZE: 10pt; FONT-FAMILY: 宋体">工作的优秀的销售经理。销售经理中最帅的一个了吧。我想在深圳这么多年追她的女孩一定不少，她老婆应该吃了不少醋吧。工作上很上心，做梦的时候高喊出单，大街上</SPAN><span STYLE="FONT-SIZE: 10pt">100</SPAN><span STYLE="FONT-SIZE: 10pt; FONT-FAMILY: 宋体">分贝喊出但单的那个人是他。</SPAN></P>
